"Missing a movement" is a crime in all military branches, very punishable. His contention is that the order for the movement was invalid because Obama had no authority to give it.
Silly man, I learned early on that you obey first, complain later. The only exception is if it's an order to commit an act that is obviously illegal in itself, like summarily executing a prisoner of war. A military movement is not in itself illegal, so this was a dumb move.

You just hit on something. Lakin should announce that he’s not a citizen and therefore was ineligible to join in the first place thus the Army court has no jurisdiction. And all he has to do is refuse to allow his BC to be released.
It is pretty simple.
Maybe his father was an American and his mother was a slut. That would make him illegitimate but not illegitimate as President.
That is the only rational reason that I can think of for him withholding the COLB.

This is just...wrong. Under the laws of this country, a child born of American parents is an American citizen, regardless of where he/she is born. By the same token, any child born in this country of any parentage is also a citizen as well. Many other countries have similar laws. The whole concept of "dual citizenship" appears nowhere in the Constitution, and isn't really addressed under U.S. law at all because all we care about is what OUR laws say, not what citizenship criteria other countries may have.
Your "dual citizenship" argument would mean that any military brats born overseas, or any other American born to their 100% American parents overseas, would be ineligible to serve as President. Because under the laws of the country in which they were born, that country would consider them a citizen as well, just as we do in the U.S..
IMHO, Lakin was used as a pawn, merely to intimidate other soldiers not to question BOs legitimacy. I suspect Lakin will be sentenced to 24 months in prison for all 4 counts.
Of course, Lakin will appeal, but like Non-Sequitur, I think that his may be denied.
On the video LTC Lakin explains to posterity, with journalists and the court reporter taking notes, that “The Emperor has no clothes” (of eligibility).
And now Mo Dowd has foolishly articulated both Lakin’s charge and the pathetic bare knuckle Obama defense: “I don't have to show you losers anything. Make me!”
