A military jury has convicted an Army doctor who disobeyed orders to deploy to Afghanistan because he questions President Obama's eligibility for office.

Here it is right out of a military publication...

But if that dismissal is due to the officer pleading guilty to the charges against him then what is there to appeal? So if the penalty imposed for missing movement alone is less than dismissal or confinement for more than one year I don't see the appeal being automatic.

You can’t judge a Muslim from Indonesia with the same standards as a Christian American.

What might be low and foul conduct for an American might be normal for Obama/Soebarkah. Who are we to judge?

I don’t see how the Army can impose anything less than the maximum under the circumstances. He may not serve the whole time but he’ll get sentenced to it and he’ll do part of it.

Not a chance. Nobody, of any political strips, is going to undermine civilian supremacy over the military.

So it's not a chance that if Obama is found not to be elible for office; his whole presidency was based on a lie, that no president would pardon Lakin in light of these facts? Oh, But Billy boy Clinton can pardon terrorists and the criminal Mark Rich? Get lost troll.

Yes , I agree this IS sad.

I don't understand why Lakin went eyeball to eyeball with the enemy (Obuttma) and then blinked, by pleading guilty. I'm not a lawyer but this was handled completely wrong by Lakin's legal staff.

Lakin should have argued that, Obuttma has openly claimed that Obuttma sr was his biological father and never was a US citizen, therefore Obuttma is at best a dual citizen. Because he is a dual citizen Obuttma can never legally hold the office of POTUS.

Those of you FRers who want to argue that Lakin disobeyed a direct order from Lakin's commanding officer, Hear this. Lakin's commanding officer has NO authority over Lakin unless it comes from that commander's superior officer and that chain of command continues going up until it rest with ONE man, POTUS.

Lakin would still have been convicted because the present system has been so corrupted by these commie bastards, no one can get a honest hearing. However, the legality of Obuttma's dual citizenship would forever be documented per this trial.

We’ll see what happens. The sentence is going to be for the whole trial. You won’t be able to split it like you want it to be unless, the convening authority drops the missing movement.

There are many names for this type of thing, but by defying his orders to report for deployment to Afghanistan he is guilty of insubordination, for one.

Basically boils down to, “was he ordered to go”, and “did he go”. That’s all the UCMJ requires the prosecution to prove. Any mitigating circumstances aren’t considered until sentencing.

So what you're saying is that all military personnel who disobey unlawful orders will be found guilty of disobeying orders and go to prison...and whether or not the order was unlawful only affects how long the stay there.
