AP: Federal court denies Joe Miller's request to immediately stop write-in ballot counts

The Alaska Dispatch reports that Beistline wrote: "Given that the questionable ballots will remain segregated and subject to subsequent review with the results recorded separately, the Court finds no good reason to enjoin counting the ballots while the underlying Complaint is addressed in due course."

Well, the good news is that the are setting the questionable ballots apart and the results will not be certified.

It’s not over. The judge ruled that the counting doesn’t have to stop because they are separating the questionable ballots so that they can be ruled on later.

They are sorting the write-ins into multiple piles. The first is the ones that are clearly not for murkowski. The others are for supposed “murkowski” votes.

One is ballots that everybody believes are good for Murkowski. According to the report, 89% of the ballots so far fall into this category. And if you do the math, if that continues, Miller will lose even if a court accepts all of his challenges.

The next are ballots challenged by miller. Challenges are judged by a local official, who so far has been rejecting most of his challenges based on her “pronouncing the name” rule — a rule that seems rediculous on it’s face, and hopefully one that the court will reject as a matter of principle.

One is a pile that everybody agrees were not done well enough to know for sure, but that number is apparently only about 1% of the total.

They are further sorted into either accepted or rejected challenges. Apparently, the local election official has rejected most of the challenges, so they are in the “counted but challenged” bucket.

There are also two buckets for murkowski challenges.

The nice thing is that the courts will be able to handle the challenges and eliminate or accept ballots from the different piles.

Give me a break! The law is the law, and Joe Miller is trying to protect it even if it is for his own benefit. We are reverting to a land of lawlessness in all regards. You prefer that the law be replaced by the whim of someone with an agenda. Thank God that someone is trying to stand up for what is right. And Joe Miller is not out there claiming to have found ballot boxes. That is a dem trick.

I read your bashing of Joe Miller, and because I have too much time on my hands I took a quick 2 minute view of your in forum posts.

My initial hunch was 100% correct, you are just to obvious!

In the 2 minute search of your previous posts,I find you call Sarah Palin a half wit, another thread you call her stupid. You totally trash COD and basically the entire Tea Party.

So you also despise Joe Miller and only because you hope somehow it will hurt Sarah Palin. You realize you are right in step with the LSM.

We knew going in that virtually all the write-in votes would be for what’s-her-name. But there are still 31,000 absentee votes to be counted, and that doesn’t happen before the 17th.

Is that 31,000 absentee ballots that have been returned and are waiting for counting, or is that 31,000 absentee ballots that were sent out? What is the deadline for all the absentee ballots to be received? Did they get ballots to military people in decent time?

If I had to pick between sore losers Murkowski and Crist, no contest.

And I would expect her to vote against cap and trade, but to tell the truth, it’s hard to find a politician we can trust.

Why is it strange that Murkowski got 98% of write-ins? Normally write-ins get less than 1% of thd vote in Alaska. This year it was 40%. It doesn’t take a rocket scientist to figure the difference is Murkowski.

Yes, but these are Tea Partiers of the most ardent sort -- facts don't really matter. If things don't go exactly their way, it's due to fraud or worse. Couldn't possibly be the candidate himself...

The real story here is the sheer magnitude of the write-in vote, which is a clear sign that Alaskans didn't much like Mr. Miller after all.

And there are a couple of corollaries. First, it's a failure of the so-called "Palin effect." -- and she couldn't close the deal in her own stomping grounds. Second, it's proof (as if more were needed) that winning the primary is not the same as winning the general election.

Does anyone seriously doubt that plurality of AK voters wanted Murky, even if they may have misspelled her name? Or that if Joe pulls out a win it will be b/c ballots cast for “Lisa Mercowski” were thrown out and AK voters will remember that? Even if he won, he be getting a primary challenger from the GOP establishment and no doubt a full on press by the dim in the general.

I wanted him to win, but he made some mistakes and many AKers are hooked on gov’t largess.

No it doesn’t scream fraud. Honestly how could it be otherwise? Miller was on the regular ballot. There is no reason to write him in. Conversely this was the ONLY way Lisa’s supporters could vote for her, so nearly all would be her votes.

With that many votes for a real candidate the % of crank votes would be reduced as a proportion.

I think they counted the absentees yesterday...Joe picked up about 2000 votes.....overall, his chances are slim...

but I hope for the sake of rule of law, Miller follows thru on his lawsuit....if you don't challenge chicanery, it'll flourish....

we did expect that the write ins would be motivated Cow voters....what I didn't expect is that not enough absentees came thru to Joe's way.....

whatever, Cow screwed the law in several ways to demand her way.....she'll never get my support nor my respect....and I don't think she'll be much in the Senate....she has shown her true colors....

Joe lost and he needs to move on. If a dim were pulling these antics we’d be all over them.

I disagree.

Alaska law states that the write in candidate's name must be spelled correctly to be counted but apparently any signature resembling Murkowski's was counted.

This is why Murkowski went to great lengths to remind voters the correct spelling of her name.

Changing the rules in the middle of the game is a Democrat strategy, and an attack on the rule of law.

Not only can Republicans not expose voter fraud in contests with Democrats, they can't even expose it within their own party.
