13 STATES FILE LAWSUIT AGAINST HEALTH CARE BILL

Attorneys general from 13 states sued the federal government Tuesday, claiming the landmark health care overhaul bill is unconstitutional just seven minutes after President Barack Obama signed it into law.

The lawsuit was filed in Pensacola after the Democratic president signed the bill the House passed Sunday night.

Florida Attorney General Bill McCollum is taking the lead and is joined by attorneys general from South Carolina, Nebraska, Texas, Michigan, Utah, Pennsylvania, Alabama, South Dakota, Idaho, Washington, Colorado and Louisiana. All are Republicans except James "Buddy" Caldwell of Louisiana, who is a Democrat.

More states will follow

Anyone who thinks this will be defeated is living in OZ.

They have orchestrated this with all these possibilities in mind. Their intent is unstoppable.

It will take a complete Republican majority and President to pass it with 60% of the vote and even then, it cannot be completely reversed.

Maybe I’m wrong, but doesn’t this have to go through the liberal DC circuit courts and a long string of judicial reviews before the USSC will even look at it?

To put it simply...we are now mandated to purchase a product based on nothing more than our respirations.

Obama falsely compared this to state required auto insurance. I do not need automobile insurance to have a driver's license. I am not required to have auto insurance to drive as long as the vehicle I drive has the appropriate coverage. I am not required to have it to BUY a car. Only if I want anyone to drive the car on public roads that I must purchase it.

If I own my home free & clear, there is no mandate that I have Homeowners Insurance.

Each of those options involve a choice.

It is now the law of the land that I will be mandated to purchase health insurance because I inhale & exhale. There is no choice. There will be new federal agents to monitor the population, looking for breathers not having the mandated coverage.

It kind of turns that radical document "The Declaration of Independence" upside down.

"...We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed,..."

My AG, Ken Cuccinelli, will be filing in Richmond’s Virginia Eastern District Court shortly.

Virginia has a different basis for its complaint. Virginia has a statute that prohibits individual Health Insurance mandates. This is a clear 10th amendment issue.

I do not think the courts will ovturn it completely in one step, but individual provisions may be able to be thrown out one-by-one until it is unworkable structurally, and thus dead...
The provision requiring purchase oif insurance which is enforced by the IRS could easily be overturned. And that would be a start.

Can you imagine a bunch of fed enforcers showing up in Kentucky to put folks in jail?

I wonder what the Kentucky national guard, sheriff's deputies, local police etc. would have to say about that, given that the state government has wiped its a** with the commiecare mandate.

I contacted the NJ’s gov, Chris Christie, to thank him for his good work so far and to ask if he would be directing NJ’s AG to file suit. They connected me to the Gov’s aide’s office and rep there stated they are reviewing various options. What does that mean? Who knows.
