Wyoming plan will fine feds $2,000 over gun rules and/or possible 2 years in jail for violations committed by federal agent enforcing U.S. regulations on firearms in the State.
Wyoming has joined a growing list of states with self-declared exemptions from federal gun regulation of weapons made, bought and used inside state borders –but lawmakers in the Cowboy State have taken the issue one step further, adopting significant penalties for federal agents attempting to enforce Washington's rules.
According to a law signed into effect yesterday by Democratic Gov. Dave Freudenthal, any agent of the U.S. who "enforces or attempts to enforce" federal gun rules on a "personal firearm" in Wyoming faces a felony conviction and a penalty of up to two years in prison and up to $2,000 in fines.
WND reported just days ago when Utah became the third state, joining Montana and Tennessee, to adopt an exemption from federal regulations for weapons built, sold and kept within state borders.
A lawsuit is pending over the Montana law, which was the first to go into effect.
But Wyoming's law goes further, stating, "Any official, agent or employee of the United States government who enforces or attempts to enforce any act, order, law, statute, rule or regulation of the United States government upon a personal firearm, a firearm accessory or ammunition that is manufactured commercially or privately in Wyoming and that remains exclusively within the borders of Wyoming shall be guilty of a felony and, upon conviction, shall be subject to imprisonment for not more than two (2) years, a fine of not more than two thousand dollars ($2,000.00), or both."

I am wondering why I left Wyoming 40 years ago? Looks better and better to retire and move back there.
I’ve always liked that state. A streak of independence runs deep through the people there, along with a healthy distrust of the federal government.
What this is doing is forcing a confrontation on the 10th and the “interstate commerce” clause.
It either has to go in favor of the states, or there will be a mass secession and reset of our country.
This is OK, except why the restriction on where the firearms are maufactured....? Does it really matter?
This is a self-limiting clause, since how many states have weapons industries?
agree.........they should’ve placed a 3 year window, in which if the gun has been ownned by the same indiv, with no gun law offenses......that gun would be “deemed” the same as if made, mfg and bought in the State of Wyo.
......but after Obama Care everyone and anyone can start “deeming” what they want or need......

The whole point of this is to force a challenge to old rulings about interstate commerce, specifically the Wickard v Filburn decision, which greatly expanded the tentacles of the federal government.
The Montana law will be the one that gets the challenge to the high court first, but showing a trend among the states toward this type of law can influence the justices’ decisions on the matter.
Several justices have expressed interest in revisiting Wickard, so it isn’t inconceivable that a decision could go our way. Overturning Wickard would be a huge advancement for the cause of limited government and freedom.

If the laws are upheld, you can bet that every gun mfg in America will relocate to those states that pass similar laws. Ditto on ammo mfgs.

I really, really hope this is a growing trend. Shut the feds out once and for all. They're involved in things that aren't any of their business.

It was a case where a man who was growing wheat on his own land for his own use was penalized by the federal government for growing more than they said he should under FDR’s agriculture laws.
The court ruled that even goods only intended for personal use can affect the flow of interstate commerce, therefore can be regulated by the feds. Overturning it could call into question everything from CAFE standards to the federal minimum wage law.
It’s an exciting idea and I hope it is successful. Rolling back the feds is long overdue.
My memory is that the FDR ag law case was eventually overturned, wasn’t it?
