Unintended consequences: Obama and company provoke 10th Amendment backlash
Renew America ^ | 7 Jan 2010 | Tim Dunkin

...now, however, the proposed nullification would be in support of a constitutional right — which removes the moral and emotional legitimacy that accrued to the Feds in the Arkansas integration case. Would Obama and Co. have the nerve to try to use the military to force New Hampshire to violate the 2nd amendment rights of its citizens? Would the military allow itself to be used in such a way?

Good States Rights article.

However, I must take exception to his use - and OVER use - of the canard that in 2008, 'conservatives stayed home'(1).

(1) A quick trip to CNN's Election Central proves how wrong that is. Its also as false as the canard that, 'Immigration cost us congress in 2006'.

(No Thread hijacking intended. Tim Dunkin just shouldn't have went there in his article.)

Actually, I would disagree. I've taken a look at a lot of the county-by-county data for 2008 vs. 2004, and there is a definite trend towards lower numbers for the Republican (with little commensurate rise in numbers for the Democrat)in already-red counties, which suggests that many Republican voters were sitting the election out. I'm pretty convinced that, once you get beyond the surface and start looking at the data, that yes, conservatives really did sit the election out, and really did contribute to "making a statement" to the GOP (now, whether the GOP listens, ultimately, will determine its future fortunes).

/////////////////////////////////////////////////////////////

I am not sure it is THE worst but it is horrific for certain. I think our forefathers had brains enough to regard government as a “necessary evil”. Too many now, even in the face of mountains of evidence against the idea, think government should be the answer to everything. Somewhere along the way we shifted from the idea of government as punisher of wrongdoing to the idea that government should ENFORCE gooddoing! Now we have the worst evil of all, a government of those who hound and harass us “for our own good”. That sort of evil never rests.

Unfortunately, that is not in the Presidential Oath of office.
It is in the one I swore.
And thats the one that counts to me.

Also, even unorganized militias would, for the most part, be reluctant to take action against friends and neighbors in the National Guard, who have been “federalized” and believe me, the Feds know this.

Keep in mind that works both ways. The Federal Governments position is much weaker on current issues than it was on Civil Rights in the 60's.

How about: Would Obama and Co. have the nerve to try to use the military to force New Hampshire to violate the 4th Amendment rights of its citizens? This "health care reform" debacle is built on demanding some of the most private of information: your health records, which should be sacrosanct and housed within the unbreachable doctor/patient relationship.

it may be questionable if the states' actions to invoke The Tenth Amendment will be upheld.

The the question becomes which is better armed, the judge or the state. A judge paid by the feds making a ruling on a case where one of the parties is the federal government is of questionable force anyway. The case should probably be heard by state jurists from nine other states instead.

The oath to be taken by the president on first entering office is specified in Article II, Section 1, of the Constitution:

I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect, and defend the Constitution of the United States.

To the contrary, I’d think the Nat’l Guard would be reluctant to ‘vigorously’ enforce this, and side with the ‘unorganized’ militias.
