Is Obama’s presidency threatened? [Birth Certificate]

Even while US Secretary of State Hillary Clinton pursues her five-day visit to India, an event has occurred in the USA that could conceivably snowball into a major controversy to cut short President Obama’s tenure. Article 2, Section 1 of the US Constitution states: “No person except a US born citizen… shall be eligible to the office of President.”

During the last US campaign a controversy arose about Obama’s birthplace. Critics were unsure if he was born in the USA or Kenya. Obama’s campaign committee released a Hawaiian birth certificate on 13 June, 2008. Sceptics alleged that it had signs of forgery.

Obama maintained he was born in Hawaii. One hospital, Honolulu ‘s Kapi’olani Medical Center for Women and Children, claims it received a letter from the President declaring his birth there. But White House Press Secretary Robert Gibbs refused to authenticate the letter. For nearly six months the hospital proudly declared Obama was born at its facility to create poll hype. Later it covered up and refused to confirm if the letter actually existed. The letter was purportedly signed by Barak Obama. If the signature was forged it was a most serious offence. Was any action taken against the Hospital?

This week the controversy about Obama’s birthplace resurfaced dramatically. A US Army Reserve, Major Stefan Frederick Cook, scheduled for deployment to Afghanistan, refused to serve claiming that the order was illegal because the American President was not legitimate. He argued that he should not be required to serve under a President who has not proven his eligibility for office. “As an officer in the armed forces of the United States, it is my duty to gain clarification on any order we may believe illegal. With that said, if President Obama is found not to be a ‘natural-born citizen,’ he is not eligible to be commander-in-chief,” Major Cook said. “Then any order coming out of the presidency or his chain of command is illegal. Should I deploy, I would essentially be following an illegal order. If I happened to be captured by the enemy in a foreign land, I would not be privy to the Geneva Convention protections.”

The military created shock waves by revoking the deployment order without giving any reasons. Thereby it evaded a reply to Major Cook’s objection and implicitly acknowledged that it could offer no proof of President Obama’s birth in the USA. If the military cannot vouch for President Obama’s legitimacy the implications can be very far-reaching. Major Cook’s case is being heard in the court of US District Judge David O Carter. The judge told the plaintiffs to fix their paperwork and that he would listen to “the merits” of their case. The date of the hearing was fixed for 16 July.

It is unlikely that the US mainstream media will highlight the event. But regardless of the judge’s verdict, will the issue die? If it snowballs into a crisis America could face a cruel choice. While it battles a severe economic meltdown it may have to either remove a most popular President or violate its Constitution.

Basically, service of the lawsuit was made on Obama as an individual and in order to make sure there wasn’t any personal jurisdictional problem in an appeal,
Judge Carter instructed Keyes to have the local U.S. Attorney’s office served per a different provision of the court rules. Fortunately, a couple of Asst. U.S. Attorney’s were in the court room at the time and Judge Carter ordered them to accept service.

The government would be in such turmoil (as if it weren’t already!)if a anti-president that had served as long as Obama had served and had done the things Obama has done. How would the country do a do-over?

Because if he's as bad as many here think he is, then there will be incredible turmoil as people wake up. More and more will follow the the Tea Party goers into the street as the situation escalates.

This administration is evil. Tyranny is the word more and more people are hearing and saying as Obama's approval numbers tank.

They're threatening everyone's healthcare. The stock market will probably crash and who knows when the economy will recover. You're looking at it from just a legal perspective and I'm telling you that America is coming to a state of rebellion on every level.

About Queens Hospital -

Can someone find the information where Obama says he was born from Queen’s hospital instead of quoting the rumor mill.

I saw a discussion that it was his sister that said it...and the Dems claim his sister was misquoted by the student doing the article.

I cant find any direct source where Obama states he was born at Queens.

The twentieth amendment, section three states:

”3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.”

This means that the "President elect" is required to provide proof of eligibility to serve to Congress BEFORE being allowed to assume the office of President. You are not legally a "President elect" until Congress has authenticated your electoral college victory, so the electoral college voter is already out of the picture once section three kicks in.

Congress, because it is given the responsibility to name a replacement should death or "failure to qualify" occurs must know that Both of these conditions have been met, otherwise how would they know when to act? This means that any member of Congress can demand to see verification of eligibility at any time he chooses to ensure that section three has been enforced. The oath of office in Article six requires that all who take it "supports the Constitution". You cannot do this by ignoring any portion of it.

I'm looking at it from an economic perspective, and the only -- repeat, ONLY -- thing that matters is: what percentage of Americans receive economic benefits from the govt.

Direct (like welfare or Social Security) or indirect (public school/babysitting). It's not about liberty and justice, it's about wallets and stomachs.

These people will not only decline to rebel, they will actively assist the authorities in rooting out rebels and lining them up for prosecution...or mass graves when the court docket gets too full.

Make no mistake. When push comes to shove, welfare recipients will be at your door with torches and pitchforks, and the govt is on THEIR side.

What it actually says: "No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President." Inaccurate quotation is how ideas like "separation of church and state" become to be imagined as being in the Constitution.

Sounds like a game to me -- if Keyes serves Obama in official capacity, he is conceding the essential point.

People bluster about CW2, they should read up on CW1. Invaders come and shoot your family, steal your sustenance, rape your women and burn your house down, and you end up feeling envy for the dead and especially those that died fast.
Nobody seems to have the slightest clue that this could happen here, though I’d bet if it does, it won’t be from fellow Americans but from foreign armies after 0bama gets done gutting our defenses and our treasury.
