Soldier who says Obama isn't president doesn't have to deploy, Army says BY LILY GORDON

U.S. Army Maj. Stefan Frederick Cook, the reserve soldier who says he shouldn't have to go to Afghanistan because he believes Barack Obama was never eligible to be president, has had his deployment orders revoked, Army officials said.

Lt. Col. Maria Quon, U.S. Army Public Affairs Officer, U.S. Army Human Resources Command-St. Louis, said Tuesday evening, Cook was no longer expected to report Wednesday to MacDill Air Force Base in Florida for mobilization to active duty. Cook is an Individual Mobilization Augmentee (IMA), meaning he is a reserve soldier assigned to an active component unit for duty. He is assigned to the U.S. Army Element of U.S. Southern Command. Last week he filed a request in federal court seeking a temporary restraining order and status as a conscientious objector through his California-based attorney, Orly Taitz.

October 2008 dismissal of complaint Taitz, who has also challenged the legitimacy of Obama’s presidency in other courts, filed the 20-page document on July 8 with the U.S. District Court for the Middle District of Georgia. In it Taitz asks the court to consider granting her client’s request based upon Cook’s belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces. Cook further states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.” Documents show Obama was born in Hawaii in 1961, two years after it became a state.

Earlier today, Quon said Cook submitted a formal written request to Human Resources Command-St. Louis on May 8, 2009 volunteering to serve one year in Afghanistan with Special Operations Command, U.S. Army Central Command, beginning July 15, 2009. The soldier's orders were issued on June 9, Quon said. "A reserve soldier who volunteers for an active duty tour may ask for a revocation of orders up until the day he is scheduled to report for active duty," Quon said. She added that there is an administrative process to request revocation of orders. As of this afternoon, Cook had not asked for his orders to be revoked, Quon said. She could not say why the soldier's orders were pulled today by 3 p.m. CDT. "Because of the Privacy Act I couldn't go into it," Quon said. A call to Cook's attorney this evening was not immediately returned. There are approximately 3,800 Individual Mobilization Augmentees in the U.S. Army Reserves. In addition to IMAs, the U.S. Army Reserves has three additional reserve levels, Quon said. Approximately 63,000 soldiers serve with the Individual Ready Reserves, meaning they have no routine training or attendance requirements and no pay; 188,000 serve as reservists, attached to reserve units; and about 16,000 soldiers serve with the Active Guard Reserve, Quon said. The latter group consists of soldiers who have volunteered to be on full-time active duty, she continued. A hearing to discuss Cook’s requests is scheduled to take place in federal court here Thursday at 9:30 a.m.

They can’t discharge him either. He follows that order, then he’s guilty of dereliction, because that’s not a legal order either.

Can you imagine the Army’s lawyer right now? Gotta be wearing Depends.

Obama clearly wants this issue go away. He has NEVER even once spoken out about the birth certificate. He may, or may not, have written a letter to that Hawaiian hospital complimenting them for assisting at his birth there. His press secretary now laughingly refuses to speak about it.

The order reversing the order to go to Afghanistan consists of just one word—and, as expected, no explanation. Again, this confirms that Obama wants silence on this issue. He doesn’t want to have to argue it.

The obvious response is for other officers to do the same thing. If there is a whole string of reversals of orders for deployment in Afghanistan, you would think that the press might have a hard time denying that it was happening—although apparently the word of more than a hundred honored Swiftboat veterans wasn’t enough to impress them the last time something like this happened.

But this certainly is where the crux lies. The military have a duty to our country, to our Constitution, and to obey legitimate commands. But as we once argued at the Nueremberg Trials, they have no duty to obey illegitimate commands.

At least Hitler was legitimately elected. The fascist Obama cannot claim as much. He is no one’s commander in chief until he proves his legitimacy against increasingly reasonable doubts. Even my liberal acquaintances are starting to wonder about this. And they can’t reach out for the COLB to comfort themselves, because it’s being expunged.

Thing is, they have rescinded this soldier’s orders. This make a litigant, who once again and not surprisingly, has NO STANDING.

That is how they are going to get around these suits. They will continue to look for ways to employ the NO STANDING strategy and not answer any question in an American court of law.

I wonder if that is why TOTUS fell apart, the other day?

Hari Kari? Well that explains Obama’s casually continuing with his syndicated TV show. He expected the traitor, TOTUS, to do what as expected, perform or die.

Then again, maybe TOTUS didn't have health care and went to a government mandated clinic with doctors from Haiti. Having gone there, probably contracted shingles and that cause the crack up.

How dare he put our military in such a position. They took an oath to uphold and defend the constitution against all enemies both foreign and domestic. A forged BC is posted on the internet and some in the military challenge his authority as CIC.

I’m sure that this will be portrayed as “un-American” by quite a few in the MSM and further divide the country.

MM, Cicero, your posts # 60 and 69 are very well said.

MrB, your #72 raises an obvious issue. If O has enough sycophants at higher command levels, he and his handlers may actually believe they can capture the US military. They will not be able to do so, but the turmoil, damage and threat to national security may be substantial.

If so, the race is on and we should do all we can starting now, even if some of what we do does not individually have much chance for success.

The behavior by Congress on January 8, 2009 resulted in a constitutional defect, apart from whether O is qualified. The defect is that in the face of the national outcry as to the lack of evidence O was even a US citizen, the Congress (who also knew O’s father was not a US citizen), did not verify O’s qualifications in its Joint Session as it was authorized to do by statute. That simple omission (believed by some to be professional negligence) put our nation in the very peril it is in today.

The cure may be to have one or more Republican member of Congress introduce a measure to correct that defect. When that member is ignored or defeated by the Democrat/Socialists, that member(s) of Congress can petition the USSC for review.

If the USSC cannot hear a plea by a member of Congress that the Congress is proceeding in a dramatically unconstitutional manner, what good is the USSC?

I urge all Freepers with a Republican member of Congress to send the petition at
