Sorry, but the Dems will spin it as an example of the evil conservative-dominated Court and as a miscarriage of justice. They will use it to show all the more reason why Sotomayor is needed to keep the court from falling futher into the hands of conservatives. To them the SCOTUS is incredibly hidebound and conservative. It's a continuous struggle, unlike many of the fist-pumping "we won" attitudes we fall into here when we get one bit of good news.
It's like breaking through a big wave on the way to port and saying "yeah, baby! We're home!"
No, there's a continuous trail of waves, and rocks, and winds and debris to navigate to dock. This is just one tiny point on the path.
Competent captains would have a strategy to stay on course no matter the obstacles.
That's what you correctly recognize in the Dem spin machine. Like it or not, no matter what happens, THEY can account for it in their plan.
If the wind turns around on conservatives, we don't have another plan-for-tacking, our leaders just throw their hands up and go with the new wind.

Have we ever had a Supreme Court nominee that has been overturned by the Supreme Court before being confirmed?I would say yes. Now whether one has been overturned while awaiting confirmation hearings? That I would venture has not happened.

"Latino\Black racists...." Fyi, from the decision itself.
Petitioners, white and Hispanic firefighters who passedthe exams but were denied a chance at promotions by the Citys re-fusal to certify the test results, sued the City and respondent officials, alleging that discarding the test results discriminated against thembased on their race in violation of, inter alia, Title VII of the Civil Rights Act of 1964.

Oh I think you are right enough. but at this point I don’t care. I am done with trying not to offend liberals. F-them, If they want to play the ram it down everyone’s throat game, we are going to have to play it as well. And do it better than they do.

Way to many things are done on the “trying to avoid a law suit” mantra. It’s about time of the avoidances ended up being something more than they wanted to avoid.

"Jeff Sessions just got a nice piece of ammo for her confirmation hearings....."Irrelevant.
She's a dog, but she's a loyal Liberal pooch.
That's all that matters as long as Liberals have an effective monopoly on the media and government.

Realistically, the good news is that swap Soto for Souter and you have no change in the outcome.
