Legal Expert-Blanco was legally in charge of Disaster Relief
Fox News | Sat 9-10-05 | ME

Posted on 09/10/2005 6:27:25 AM PDT by MNJohnnie

Just watched a legal expert on Fox go thru the disaster event by event. Based on the Law Gov Blanco is legally liable. If lawsuits are filed, there is no way she can duck it. In addition, when Bush went went down there, he offered her immediate deployment of Reg Army troops, she told both him and Nagel that she "needed 24 hours" to decide. This is DC politics. As everyone from Bush to Clinton to Carter learned, Washington Politics are a whole lot tougher then local politics. Blanco is toast. EVEN if the National Dems get the "Independent Commission" there is no way to rescue her based on the Law. I suspect that is why Mayor Nagel has been so quiet. He found out last Fri just who was holding the knife in his back, and it wasn't Bush

The second site is supposed to be founded by a conservative. Look what it says on their site - that the Red Cross did not enter because they were prevented.

Hurricane Katrina hits Louisiana and Mississippi coast as a category 4 storm. A reported 9,000 people are in the Superdome.

(Look at this)

FEMA press release: 'First Responders Urged Not To Respond To Hurricane Impact Areas Unless Dispatched By State, Local Authorities'
http://www.fema.gov/news/newsrelease.fema?id=18470

Quote: Michael D. Brown, Under Secretary of Homeland Security for Emergency Preparedness and Response and head of the Federal Emergency Management Agency (FEMA), today urged all fire and emergency services departments not to respond to counties and states affected by Hurricane Katrina without being requested and lawfully dispatched by state and local authorities under mutual aid agreements and the Emergency Management Assistance Compact.

Five hours after the hurricane hit, FEMA chief Michael Brown asks Homeland Security Secretary Michael Chertoff for approval to send 1,000 Homeland Security workers within 48 hours to the Gulf Coast to provide assistance.

(This is where the real troubles began)

17th Street Canal levee breaks.
http://www.nola.com/hurricane/t-p/katrina.ssf?/hurricane/katrina/stories/083005_a1_risingwater.html

...The Red Cross, while providing relief and support across the Gulf Coast, did not enter New Orleans to provide relief at the Superdome, or any other victim shelter in the city.
http://www.redcross.org/faq/0,1096,0_682_4524,00.html
http://www.post-gazette.com/pg/05246/565143.stm

(This is partially what it says)

The state Homeland Security Department had requested--and continues to request--that the American Red Cross not come back into New Orleans following the hurricane. Our presence would keep people from evacuating and encourage others to come into the city.

Evacuation of the Superdome begins.

Thursday, September 1, 2005

Bush tells "Good Morning America" that "I don’t think anyone anticipated a breach of the levees."

Secretary of Homeland Security Michael Chertoff claims "we have a tremendous array of forces that are currently deployed in New Orleans," as cable TV networks show live images of looting, Superdome residents awaiting evacuation and people stranded without food and water throughout the city.
http://www.dhs.gov/dhspublic/display?content=4779

By the way - the NO Plan of evacuation was to house the people in the Superdome with no "plan" to have food and water provided. Can you believe that?!!

It is like I said - NO Plan was NO plan!

Need some legal beagles to help out here. I was under the impression that state officials were pretty much insulated from lawsuits resulting from actions (or inactions) on the job.

There is no statutory requirement for the Gov to even have Disaster Relief. The Gov can declare a disaster and thereby free up some emergency funds. That's about it.

Yeah, I got corrected by Law Freepers fast. The STATE, not Blanco would be legally liable for Blanco's actions. The point, which I misstated completely, was that Blanco was, and is, legally and operationally in command. I think the distinction is pointed out in like one of the 1st 10 posts or so

But Nagin stocked the Superdome for three days on Sunday. Evacuees were admitted Sunday evening, so food should have run out on Tuesday evening, or some time Wednesday if it was rationed appropriately.

Do you have a reference for this? I was under the impression that the Superdome was not stocked at all. The emergency plan called for that to happen, but I had heard that did not happen.

Those were HIS buses sitting there.

Want to hear JJ's EXCUSE for those buses not being used?

This morning the "Reverrrrend" said the Mayor did NOT have the RIGHT to bus the people OUT OF THE CITY. Then as an after thought he tagged his statement with "if they didn't want to go".

However it was George Bush's fault because he and the RED CROSS were NOT THERE ON TUESDAY!!!

Nothing he said made any sense and Neil Cavuto tried his best but without acting like a crazed Democrat there was no way he could get a coherent sentence from the "Reverrrrrend".

Her name was Blanco.

May be Blanco or she may be inept and her DHS staff is where the real corruption (moral or legal) is. After all that IS the same office where the 3 officals are facing obstruction of justice charges

For Nagin's next election campaign...the opposition should put bus pictures up around town and simply ask...when you need a good bus...who are you going to call?

Even thought this week the MAYOR issued the "Use force to evacuate" order. Even though the City of NO own PLAN calls for the use of the buses. JJ is just another partisan bigot helping the Dem violate his OWN fellow citizens.

t is my understanding that the average time for FEMA's arrival is about four days. The media and Dems were screaming for FEMA the day of the flooding.

FEMA cannot respond until the Governor requests their help. I don't know the exact time, but it was several days after the hurricane before Blanco requested FEMA assistance. I'll bet, based on the trigger of a Governor's request, that this was about the fastest FEMA response to date.

You are the one the references a left wing Blog?

Actually if they DHN and FEMA don't what you wanted they to do there would have been a whole lot more recriminations than you're seeing right now.

The fact is that CG works for DHS so all your talk about Brown and Chertoff is just plain wrong and BS. If it wasn't already in their mission statement the CG wouldn't have even been in a position to do anything.

Again the CG didn't need permission from anyone! Is there something difficult to understand about that concept.

"PS Did you add National Review and Novak and Lott to your leftist list?

PS You don't have to be a leftest to be wrong, some time people are just wrong. Lott is trying to do what the voters elected him to do but that doesn't make him right on this issue. He's has always brought home the bacon in the past and I'm sure he will continue to do so in the future.

The disaster plan called for up to 10,000 citizens to remain in the city.

I just heard an interesting comment from a friend, about the buses. He has heard that the buses are insured and the insurance will pay for flood damage - but NOT if they were flooded during use in an evacuation.

Anyone know anything about this?

Sounds like people are making up b---s--t excuses for why they weren't used. No insurance policy would be written like that.

Until he stops being a girly-man and starts fighting back, I give Bush a big fat zero approval rating. I dont understand his meek stance, afterall, he has facts on his side.

What do you think WE all are doing. The President has to be President of ALL the people, not just the Conservative Movement. It may make Cast Iron Conservatives happy but to most voters a President "fighting back" sounds like he is COVERING UP. Cast Iron Conservatives need to ask themselves "am I helping or hurting the agenda" when I spend all my time whining about Bush instead of helping GET THE FACTS outs. Instead of sitting around day after day whining on Conservatives sites, maybe I should writing my Congress critters to demand they investigate the WHOLE system, Local, State and Federal. See Moveon and other Hate Left groups use "conservative" whining about Bush to claim "bipartisan" support for their attacks. All this whining at Bush to "fight back" does is HELP the Enemy. Cast Iron Conservatives need to quit sitting on their butts whining and help FIGHT BACK.

That is funny. What are the words to that song? Surely, we could make that the theme song for Nagin's disaster.
