SEN. SCHUMER CAUGHT ON CELLPHONE: 'WE ARE GOING TO WAR' OVER SUPREME COURT

Senate Judiciary Committee member Chuck Schumer got busy plotting away on the cellphone aboard a Washington, DC-New York Amtrak -- plotting Democrat strategy for the upcoming Supreme Court battle.
Schumer promised a fight over whoever the Presidents nominee was: It's not about an individual judge
It's about how it affects the overall makeup of the court.
The chairman of the Democratic Senatorial Campaign Committee was overheard on a long cellphone conversation with an unknown political ally, and the DRUDGE REPORT was there!
Schumer proudly declared: We are contemplating how we are going to go to war over this.
Schumer went on to say how hard it was to predict how a Supreme Court justice would turn out: Even William Rehnquist is more moderate than they expected. The only ones that resulted how they predicted were [Antonin] Scalia and [Ruth Bader] Ginsburg. So most of the time they've gotten their picks wrong, and that's what we want to do to them again.
Schumer later went on to mock the Gang of 14 judicial filibuster deal and said it wasnt relevant in the Supreme Court debate.
A Priscilla Owen or Janice Rogers Brown style appointment may not have been extraordinary to the appellate court but may be extraordinary to the Supreme Court.
By the time the train hit New Jersey, Schumer shifted gears and called his friend and Gang of 14 member, Republican Sen. Lindsey Graham.
The two talked in a very friendly manner about doing an event sometime this week together.

Uh, who was the last SC Republican to be denied primary renomination? Uh, rephrase that: has ANY SC Republican ever been denied renomination, save for a few state legislators?
When Lindsay was on Hannity tonight, he seemed to say that asking nominees how they would rule in Roe v. Wade type case, would be off-limits...
AND, he said that since Janice Rogers Brown, William Pryor, and Priscilla Owen are all pro-life, and they were confirmed, that can't be considered an "extraordinary circumstance"---
He also said that he would hold the democrats in the GANG of 14, to their word, that they wouldn't filibuster because of judicial philosophy...
I think we have to give Andrea Mitchell the title of Dems Head Cheerleader...she practically had out her pom-poms when Leahy was on...
BTW, according to Leahy, they are not going to be "bound" by the timetable the President made, of having a justice ready to start in October..
He said that the President doesn't have the "right" to tell the Senate what their timetable should be, then he said that IF this becomes ugly, and a long drawn out process, it will be Bush's fault...
for nominating a "divider, not a uniter"...therefore, the country must be told it is HE, not the dem Senators that is causing the problem.
I don't see Lindsey holding them to their word.

The other situation you referred was illegal because it intercepted an electronic signal in violation of the so-called "Electronic Communications Privacy Act" (ECPA).

The point is, he's supposed to have the "advice and consent" of the Senate for any nominations.
Lets get one thing perfectly clear. The dems are using the filibuster to PREVENT A VOTE. Because THEY KNOW THE NOMINEES ARE QUALIFIED AND WOULD BE CONFIRMED.
So they are refusing to do THEIR CONSTITUTIONAL DUTY, which is to say yea or nay to a nomination.
If Bush was to make recess appointments, the shoe would be on the other foot. When Congress came back in session, the dims would have to PROVIDE SOME SORT OF EVIDENCE THE APPOINTED PERSON WAS INELIGIBLE.
Yeah, the whiners in Congress would scream bloody murder. But they would totally understand why it was done. And it might put any more nominations on the fasttrack for a vote.
Please name one thing - just one - that has changed since that deal went through. (You know, other than the confirmation of six separate judges, including at least two "controversial" nominees.)
Let's see what happens.

Coop, "The Deal" is the change. It took focus off the constitutional option... That's the whole ball of wax. The target is not the judgeships in the fed courts, that was the unknowing ploy that has worked so far for them dems, because the dems had NOTHING, before the deal. There is not ONE of those Judges appointed that will make a tinker's damn bit of difference in the next 2 years! It's using the CO that matters. It's appointing Bush's nominees to the SC that's important.
When the President nominates a SC judge and the dems bring up "EC" tell me, what you think is going to be the FIRST thing Frist will do?
He can't even begin to bring up the CO because the dumbass moderate idiot Repubs will be debating what EC means!!!!!!!!!!!!!!!!!!
Why is there all this talk of WAR? Not just Schmucker, but rambling all over the press.
