Last week's U.S. Supreme Court 5-4 ruling in Kelo v. New London helps explain the socialist attack on President Bush's nominees to the federal bench. Let's look at the case. The city government of New London, Conn., has run upon hard times, with residents leaving and its tax base eroding. Private developers offered to build a riverfront hotel, private offices and a health club in the Fort Trumbull area. But there was a bit of a problem. Owners of 15 homes in the stable middle-class Fort Trumbull neighborhood refused the city's offer to buy their homes. But no sweat, the city turned over its power of eminent domain -- its ability to take private property for public use -- to the New London Development Corp., a private body, to take the entire neighborhood for private development. The city condemned the homeowners' properties. The homeowners sued and lost in the state court, and last week they lost in the U.S. Supreme Court. The Framers of our Constitution gave us the Fifth Amendment in order to protect us from government property confiscation. The Amendment reads in part: "[N]or shall private property be taken for public use, without just compensation." Which one of those 12 words is difficult to understand?

I think the socialist attack on judicial nominees who would use Framer-intent in interpreting the Constitution might also explain their attack on our Second Amendment "right of the people to keep and bear Arms." Why? Because when they come to take our property, they don't want to risk buckshot in the backsides. In my neighborhood it will more likely be 50 caliber.

No surprise that Walter Williams understands the Constitution better than the felonious 5.
Which one of those 12 words is difficult to understand?
They aren't difficult to understand assuming that you aren't on a Socialist Jihad against America.
America's socialists want more control over our lives, property and pocketbooks. They cannot always get their way in the legislature; the courts are their only chance.
Says it all really.

In recent years, the teaching of how checks and balances work in America to guard freedom has virtually come to a standstill. This ruling by the Supreme court joins a long list of blows to our basic form of government and to our most sacred documents which were set up to protect individuals against confiscation of their property..They (the courts) have already confiscated our intellectual property regarding the free practice of religion without interference of goverment through a tyrannical court system. Now, it is time to hold to the fire the feet of our elected representatives regarding these court rulings. They have the power to stop this madness..If they do not, then I predict civil war down the road. Americans will roll over only so far on this.

You saved me a lot of copy and paste my friend. Mr. Williams in his last two paragraphs said it to perfection. WTF is going on in America? Has the left finally one with the courts?

This reminds me of Jezebel who had Naboth stoned to death in order for Ahab to get the vineyard he wanted. So in modern times at least eminent domain doesn't include the death penalty. Everything else is the same.

Always glad to help.
Has the left finally one with the courts?
And in the education system. I'm sure that was the plan all along.

Another, more subtle, taking of property is via environmental wacko motives. While they don't take the physical piece of paper called the deed, some nut rules the swamp rats must be saved and thus you cannot develop your own property and you're stuck with it.

Isn't the Fiat made by the French?
Can't get much more 'socialist' than that.

"If they do not, then I predict civil war down the road. Americans will roll over only so far on this."
Respectfully, I must disagree with you on half of your sentence copied above. Americans are far too happy with what they have built in this land and will not wreck it with another Civil War.
What they almost certainly will do is shoot the offending individuals. To use an analogy with current military weapons, look on Americans as a potential "Smart weapon" not the old fashioned unguided iron bomb.
Hopefully, it will not come to that. What we are observing now with the Kelo decision and the California Coastal Commission decision is, I hope, the high water mark of the flood of socialism that crept into America when the Democratic party was taken over by the Commies and Socialists displaced from their original organizations by Sen. McCarthy.
My guess is that America will drop the "Liberal" or commie, or socialist pols and judges. And count on their so doing without the costs and suffering of a Civil War.
On the other hand, if I were one of the Foul Five, I'd be thinking of retiring to some place far, FAR away. And soon.
Free citizens will only tolerate infringement of their Unalienable Rights. They won't tolerate abolishment of them.

Are you saying that Souter is a homosexual? Is there any hard data on this? Other than the fact that he just screwed American in a most perverse manner.
OOPS! Let me change that to "reliable" data.

Just because the gov't gets more money to blow, doesn't mean the public necessarily benefits.
