They change their minds?
bump
It's time to start making some arguments based on "ineffective assistance of counsel".
I've never seen anything related to the Florida Supreme Court that would lead me to believe they would be the least bit receptive to an appeal of this kind.
Governor Bush, please project yourself forward to that point of Terri's death. Ask yourself, "did I do everything but that final thing that was necessary? Did I pull the arrow from the quiver only to hesitate? Did I listen to my conscience or did I listen to my advisors?"
God bless her parents. They will not give up.
The Legal Eagles in this case are playing a game of "Simon Says" with these people. They make rulings, then it leaks out that "if they had said this" or "if they had done that" the ruling "MIGHT" have been different. The ultimate tease. So they didn't file things just right, can't we at least feed and hydrate her while we are all fightng about it? Are any of you out there lawyers in areas where you could help here??? Pro Bono?
I believe the courts are pointless. Greer has the legal authority under the statute to remove the tube. Just go in and give her water and see if she can take it. Greer's order that no one can give her water is illegal on the face of it. The statute only allows Greer to remove "artificially" supplied food and water.
It might take an emergency order or better yet forget the courts and get the Governors office to take marshalls to tell whatever law enforcement is on site to stand down -- the courts do not direct law enforcement, the Governor does -- and let medical doctors try to hydrate her by mouth. Can't Jeb Bush do even this much to give Terri one last chance?
I assume that state judge AP is really referring to is that "county probate" judge.
Why isn't this in the Breaking News section?
They must ignore the pro-death crowd who are acting like the Schindlers' fight for Terri's life is "disturbing" Terri's "peaceful death."
How ironic that the pro-death people won't give Terri the right to live, but they'll defend her right to "privacy."
Shallow folks, like Geraldine Ferraro
God Save Us! There, but for Your mercey, goes each and every one of us.
I mentioned this is a post last evening, but if MS and the judges are correct, there should be no need to bar family members from offering her shaved ice by mouth. Their argument is that she must be kept alive by life support, and she is therefore in a PVS. If that is true, the pull the feeding tube but allow her to have liquids, jello or anything else she can swallow. The fact that they are using guns to keep the parents from offering her even a few drips of water illustrates that they know very well that she can indeed take hydration and possibly even nourishment by mouth.
Nope, not going to be accepted.
Her parents just filed an "all writs appeal" of some 90 pages with the Florida Supreme Court according to cnn.
