Senior Judge Kevin Hess when sentencing Cleary on Monday considered those factors before delivering a sentence below Pennsylvania’s guidelines for the crime. Cleary faced a maximum of 10 years in prison. Initially, the two sides proposed a sentence of four to eight years.
“The defendant has admitted his guilt,” Hess said. “He’s come forward and even though 10 to 11 alarming years have passed in the meantime, we wouldn’t be here today but for his hope for some kind of forgiveness and contrition.”
Victim Shannon Keeler first went to police nearly 12 years ago.
“The system meant to protect me protected you instead,” Keeler said in a roughly 10-minute-long victim-impact statement . “This isn’t just my story. It’s the story of countless women.”
Keeler’s lawyer, Andrea Levy, called Cleary’s sentence “certainly less than he deserves,” but also expressed relief that the case was over.

Senate Minority Leader Chuck Schumer, D-N.Y., said his party will provide the necessary votes only if Republicans promise to renew the pandemic-era expansion of the Obamacare Premium Tax Credit, set to expire Dec. 30.
Republicans have refused to make such guarantees without long discussion and accused Democrats of turning the normally bipartisan government funding process into a “political game.”
During a White House luncheon Tuesday, President Donald Trump called the shutdown “a pointless act of partisan spite” from Democrat “obstructionists.”
“From the beginning, our message has been very simple: we will not be extorted on this crazy plot of theirs. They’ve never done this before, nobody has – you always vote for an extension,” Trump said. “Today I’m calling on every Senate Democrat to stop the madness.”
Senate Democrats have so far voted down the House-passed CR eleven times, and negotiations are currently at a standstill as both sides try to wait each other out.
“We have offered them several off-ramps now. The Democrats want something that’s totally untenable,” Senate Majority Leader John Thune, R-S.D., told reporters later. “People keep saying, ‘Negotiate!’ – Negotiate what? I don’t know what that is right now. The government needs to open up, and then we’re happy to sit down and talk about any other issues the Democrats want to talk about.”
Thune indicated that Republicans will continue with their current strategy of forcing vote after vote on the CR in the Senate, adding that he hopes Democrats “get wise.”

Defense Secretary Pete Hegseth announced Wednesday that the U.S. military has conducted its eighth strike on a suspected drug-smuggling boat in the Eastern Pacific.
The Tuesday night strike was in the Pacific Ocean, unlike the first seven in the Caribbean Sea, according to the Associated Press.
Hegeth said in a social media post that the strike occurred on a vessel being operated by a “Designated Terrorist Organization” that was conducting “narco-trafficking” in the region.
“The vessel was known by our intelligence to be involved in illicit narcotics smuggling, was transiting along a known narco-trafficking transit route, and carrying narcotics,” he also wrote.
In addition, Hegseth said the strike was conducted in international water and both narco-terrorists aboard were killed.
“Just as Al Qaeda waged war on our homeland, these cartels are waging war on our border and our people. There will be no refuge or forgiveness – only justice,” he also said.

Wolff claims that Melania Trump launched a campaign of threats to intimidate him and keep him from delving into the friendship between the Trumps and Epstein.
“These threatened legal actions are designed to create a climate of fear in the nation so that people cannot freely or confidently exercise their First Amendment rights,” Wolff’s 17-page lawsuit states. “The threats are also intended to shut down legitimate inquiry into the Epstein matter.”
Wolff claims in his lawsuit, which was filed Tuesday in Manhattan Supreme Court, that the first lady threatened to sue him for $1 billion if he went forward with the book, titled “The Art of Her Deal: The Untold Story of Melania Trump (Redux).”
In the book, Wolff claims to have hours of interviews he did with Epstein, and he says that Epstein claimed that the Trumps first had sex together while flying on his private jet. He also claims that the Trump marriage is a “sham.”
Wolff made public some claims from the book in a Daily Beast podcast in July. But the news site later retracted and apologized to Melania Trump for the story they published based on Wolff’s salacious claims.
