Yeah, About Those Contempt Hearings Boasberg Was Mulling for Trump Officials...

Judge James Boasberg got gutted last night: the Supreme Court ruled that the Trump administration can deport illegal aliens, they can invoke the Alien Enemies Act, and there’s nothing he can do to stop it. The little judge got owned, but Boasberg was mulling contempt hearings for Trump officials over the deportation flights, which is absurd. His rulings were vacated, but it seems he is hell-bent on holding this administration in contempt and beyond.

The core of his argument has been smashed into dust, but one can still be held in contempt of rulings on appeal.

If a judge wishes to hold a member of the executive branch in contempt, he may do so to his heart's content, but he can't enforce that ruling without the cooperation of the executive.

A judge could hold Congress in contempt, but there is no mechanism for enforcement.

In theory, the judiciary is apolitical, but we all know better by now. The discussion of Democrat versus Republican judges is dangerous for the rule of law, but then again, the courts are not the place for legislating. The issue of right versus wrong is to be decided by the people's legislature, not the courts. I should note that Earl Warren told his clerks that he didn't care about the law, only right versus wrong.

Congress can declare somebody to be in contempt, but only the AG via federal marshals can enforce that ruling.

The executive cannot rule anybody in contempt.

To clarify: “Can one ‘branch’ of the government find another ‘branch’ in contempt?”...for exercising its Constitutional duties?


It seems to me that the ability to hold members of another branch in contempt is an appropriate check and balance on the other branches. Enforcing it is another matter, entirely. And without the ability to enforce it, the contempt finding becomes nothing more than an historical footnote for future historians to note when relevant. Kind of like a failed impeachment. Unless, of course, the person found in contempt knuckles under.

But isn’t that contempt, or contempt of the Judiciary, included in the “high crimes and misdemeanors”?

There seems to be an inequality (set-up!) here, when one branch can visit this on another?

But now I think that only Congress can prosecute impeachment of the other 2.

If Boasberg lacked jurisdiction in the case ab initio, I am doubtful that he could proceed with any contempt hearing.

Good morning, friends. I think this case should be in Kash’s hands to get all the background on this Judge and his family. Then, hand the results to Florida’s finest ex-atty general. Get him, Mrs Bondi, and hang him high so his fellow Judges know who the real leader in America is.

Boasberg needs to be permanently relieved of his bench based on mental illness, namely multiple personality disorder; ; he has been both judge and plaintiff lately, even to the extend of doing the usual leftist scam of judge shopping for the anti-Trump crowd.
