Federal judge temporarily pauses RFK Jr. effort to rescind billions of public health funds

A federal judge granted a temporary restraining order Thursday that stops the Trump administration from pulling back more than $11 billion in public health funding from state and local health departments.

Judge Mary McElroy of the federal district court in Rhode Island granted a 14-day restraining order to a group of 23 states and the District of Columbia that filed a lawsuit against the Department of Health and Human Services (HHS) earlier this week.

“The likelihood of success on the merits is extremely strong,” McElroy said at the conclusion of the brief hearing, noting that “the record is voluminous … with allegations of irreparable harm” if the funding were to cease.

The states asked for a preliminary injunction and temporary restraining order to stop the cuts from taking effect. The officials claimed the administration acted unlawfully, without any analysis of benefits of the health funding or the dire consequences of termination.

The HHS said the funds, totaling $11.4 billion, were primarily used for COVID-19 response including testing, vaccination and hiring community health workers. Since the pandemic has ended, the HHS said the funds would be rescinded.

The lawsuit argues the federal government does not have the legal authority to unilaterally rescind funding it already allocated, particularly when states have built essential health programs around the commitments.

What’s with this “temporarily” BS? Trump needs to sue these damn “judgies” for the money wasted for them to have to stand around “temporarily” while the judgy is off dumping a load.

Below is the kind of logic in DC that frosts the hell out of me. Talk about waste and fraud.

There is a case to be made if the money was already approved for legitimate purposes. For instance the Federal government forces requirements on public water systems. It is the states that have to enforce them. Testing the water and enforcing those regulations costs lots of money.

United States District Court for the District of Rhode Island

Mary S. McElroy: On September 8, 2015, President Obama nominated McElroy to serve as a judge of the United States District Court for the District of Rhode Island, to the seat vacated by Mary M. Lisi, who took senior status on October 1, 2015.

She received a hearing before the Senate Judiciary Committee on December 9, 2015. On January 28, 2016, her nomination was reported out of committee by voice vote. Her nomination expired on January 3, 2017, with the end of the 114th Congress.

On April 10, 2018, President Trump announced his intent to renominate McElroy to the same seat. On April 12, 2018, her nomination was sent to the Senate. On October 11, 2018, her nomination was reported out of committee by a 19–2 vote. On January 3, 2019, her nomination was returned to the President under Rule XXXI, Paragraph 6 of the United States Senate.

On April 8, 2019, Trump announced the renomination of McElroy. On May 21, 2019, her nomination was sent to the Senate. On September 11, 2019, her nomination was confirmed by a voice vote.

Voters only care about results. Most don’t pay attention to judges stopping anything. Voters will vote on prices of items, tax situations, and job security.
