Judge fumes over late-night deportation move signed ‘in the dark’

A federal judge grilled Trump administration lawyers Friday over the deportation of Venezuelan nationals to El Salvador despite an earlier court order explicitly blocking the move. It was the latest in a legal dispute that could reach the Supreme Court.

During a motion hearing, U.S. District Court Judge James Boasberg questioned Deputy Assistant Attorney General Drew Ensign about why the Trump administration failed to comply with an emergency court order that temporarily blocked its use of the 1798 Alien Enemies Act to deport Venezuelan nationals, including alleged members of the gang Tren de Aragua, from U.S. soil for 14 days.

At least 261 migrants were deported Saturday from the U.S. to El Salvador, including more than 100 Venezuelan nationals who were subject to removal "solely on the basis" of the law temporarily blocked by the court.

Boasberg used the first portion of Friday's hearing to press Ensign for details over the government's deportation flights to El Salvador.

"Why was this proclamation signed in the dark on Friday, early Saturday morning, and then these people rushed onto the planes?" Boasberg asked Justice Department attorneys. "To me, the only reason to do that is if you know the problem, and you want to get them out of the country before a suit is filed."

Ensign was also pressed at length over what he knew about the deportations during last week's court hearing, when Boasberg ordered the Trump administration to temporarily halt any planned removals of Venezuelan migrants subject to the Alien Enemies Act.

Oral orders from a judge are not appealable. Written orders are. This judge knew his oral order wasn't legal, and therefore didn't put it in writing. Now he wants to say "you didn't do what I said. Screw my written order." Bad judges do illegal things and then frustrate appellate review. That's what this judge did. He should be smacked down with a writ of prohibition and ordered to pay the costs. I doubt CJ Roberts will do that.

This “special” little influence-peddling club that Roberts and this guy belong to is a big, big, big deal.

That’s why they have been going after Thomas for taking a few vacations with rich guys. He’s not in their pay-to-play little club.

Time to file charges.

judge getting a life lesson that he cannot, and has no right to, control many things in this world, and he doesn’t like it. judge needs to grow up.

Since he seems to be fixated on the Trump administration’s tactics to get the gang members out of the country, I suppose the government could ask the judge why this case was shopped to a liberal anti-Trump judge.

So this judge can only think of one reason why the government acted quickly. And is assuming the government knew it was acting illegally.

I’m seeing more and more statements by the Obama/ Biden judges that are straight out political rhetotic, with no legal reasoning.

I still think Pam Bondi needs to say that since the judge didn’t recuse himself even though he has THREE first-degree relatives who stand to gain financially from his rulings, they have no reason that he wouldn’t leak National security secrets to those 3 first-degree relatives for their financial gain as well.

From what I have read, every single court that has looked at a case under this law has ruled that the issue is non-judiciable. This district court jester disagrees, and demands that the administration kow-tow to his dictates.

SCOTUS should preemptively shut him down. Making the administration follow the “normal appeals” process is casting shadow on the previously determined (including at SCOTUS) non-judiciable nature of the issue.

Roberts is way out of line on this.

Judge “Biasberg” strikes again.

Few know that CJ Roberts of SCOTUS appointed this radical asshile as a FISA COURT judge who later issued all of the search warrants to the FBI on DOnald Trump and his staff, based on the false Russia hoax.

Biasberg has a hate o for Trump. Hopefully he will either be impeached or silenced an Apepllate Court or by Congress revoking or suspending federal jurisdiction of the federal district courts.
