Service members sue Trump administration over transgender military service ban

Lambda Legal and Human Rights Campaign, two leading LGBTQ+ advocacy groups, filed a federal lawsuit on Thursday challenging the Trump administration over the president’s executive order banning transgender people from serving in the military.

The lawsuit, which was obtained by ABC News, was filed in the U.S. District Court-Western District of Washington on behalf of six active duty transgender service members, a transgender person seeking to enlist in the military, as well as Seattle human rights organization Gender Justice League.

"By categorically excluding transgender people, the 2025 Military Ban and related federal policy and directives violate the equal protection and due process guarantees of the Fifth Amendment and the free speech guarantee of the First Amendment," the lawsuit said. "They lack any legitimate or rational justification, let alone the compelling and exceedingly persuasive ones required. Accordingly, Plaintiffs seek declaratory, and preliminary and permanent injunctive, relief."

U.S. Navy Commander Emily "Hawking" Shilling, who according to the lawsuit has been serving in the military for 19 years, criticized the ban in a statement, saying that the measure is "not about readiness or cohesion, and it is certainly not about merit."

"It is about exclusion and betrayal, purposely targeting those of us who volunteered to serve, simply for having the courage and integrity to live our truth," Shilling said,

The lawsuit comes after President Donald Trump signed an executive order on Jan. 28, rescinding Biden administration policies that permitted transgender service members to serve openly in the military based on their gender identity.

The order directed the Department of Defense to revise the Pentagon’s policy on transgender service members and stated that "expressing a false "gender identity" divergent from an individual’s sex cannot satisfy the rigorous standards necessary for military service."

The military is not a laboratory for social experimentation. It’s exists to kill enemies and destroy their capacity to make war.

Alphabet people are incompatible with good order, morale, and a functioning chain of command. Administrative separation is called for and has been … in the past.

Too much time wasted for recovery.

Nor should the government pay for ANY elective surgery. And that kind is.

If you choose to undergo something like that, pay for it yourself.

It’s really a medical issue. Having said that, the one who served 19 years, I’d give her/him/it their full 20 year retirement.

That's all well and good but if you miss muster tomorrow over your elective medical situation you get an Article 15 hearing for willfully damaging Government Property.

Has literally 0 bearing. Anyone can claim anything in a lawsuit, does not mean it actually has merit.

No one in the military is allowed to have elective surgery that literally prevents you form being combat ready EXCEPT transgenders, if anything they are violating equal protection.

Honestly even women should be booted due to pregnancy possibilities, all pregnancies except forced are elective.

In my time in the Navy I saw several women get pregnant just to avoid a patrol. Total garbage and yes it does piss of the fathers who sacrifice when serving.

all who sign up for military service lose their “free speech” as a condition of service. once someone has received a service number THEIR ass belongs to the government. figuratively AND literally! yep...gender butchering is vandalism and/or destruction of government property.

I read of a guy who was enlisting and detailed why- he enlists and informs his CO he is trans which starts the process. Mental health care, physical exams, starts hormones, has surgery, goes through recovery and by then, his commitment is fulfilled and he leaves the military transitioned with having no real duty as he is on pain meds, hormones and his recovery takes up all the time.

He was crying because in Trump’s first term, trans stuff was being addressed and he whined that he wouldn’t be able to have his surgery if he was banned from the military.

Ya some I still keep in touch with have seen this personally. When I was in back in 83-89 no woman served in a sub. However some did serve on tenders for example and yes they did get pregnant to avoid long patrols.

This will be blocked within days by any random circuit court commie. The problem is is that I’m not sure we have the votes on the supreme Court to stop this. Gorsuch and Conehead Barrett are not reliable.

Trump 2.0 is Lawyer nirvana..

Lawfare, via complicit stooges in black robes, manipulate the "Justus" system, raking in Billions (most of it coming from Taxpayers).

When everyone from Magistrates, to Federal Appeals Judges, can impose nationwide bans on Laws, and the Appeals process bogs down for years, we have un-elected TDS-infested chaos (which is the whole purpose of Lawyers).

In the case of mentally-challenged alphabet soup claimants, they should be found to be mentally incapacitated, and not impose their "derangement" on the rest of the population.

The military is not bound by societal silliness, in terms of staffing with warriors, not cross-dressers and deranged societal mis-fits.
