HILLSIDE — In the latest hot spill lawsuit against Dunkin' in New Jersey, a Union County woman claims she suffered severe and permanent burns on her hand due to negligence.
Essence Springer bought a hot mint tea at the Dunkin' drive-thru on Liberty Avenue in Hillside on Dec. 17, 2023, according to the lawsuit filed last week.
After being handed the tea, the hot drink spilled on her hand.
The ensuing burn forced Springer to miss work and her other "usual activities," according to the lawsuit. It also racked up expensive medical bills.
The lawsuit said an employee didn't properly secure the drink's lid and the tea was "excessively hot."
Springer is seeking a jury trial.
Dunkin' faces several hot spill lawsuits in New Jersey each year.

I really don’t see how we can have hot drinks in today’s society.
And if the drink wasn’t hot, the customer would be complaining about it...
Legally speaking we may not be able to have such hot drinks anymore.
I’m sure the legal counsel for Dunkin’ Donuts is looking very closely at all of this. And legal counsel for places such as Starbucks will also be watching such cases very closely.
The insurance carriers for these sorts of establishments are also going to be involved.
Eventually it may just be too risky legally speaking to serve hot beverages.

It is such a shame that we have become such a sue happy society, I owned restaurants for 30+ years and NEVER had a lawsuit, I would NEVER get into that business today NEVER!!
Has anybody sued over an iced coffee injury yet?
It’s coming.
Making coffee or tea very hot masks the poor quality of the drink.
Kind of like loud music covers up poor singing.
It’s a business cost to settle lawsuits…make the drinks the proper temperature and customers complain about the taste.
Then buying quality ingredients will cost more, so just settle the lawsuit and save money.
Who would buy tea there?
Who buys a tea at Dunkin Donuts? That is like looking for cowboy-style chaps on Jermyn street.
Hillside is Newark. Around there an inflated injury settlement is a good days work.
Cups must be equipped with digital thermometers so customers can be aware before accepting custody. Lid integrity seals too.
Next time, buy an ICED TEA, lady.
I have been handed cups of coffee that didn’t have the lid on securely, so I always check them. I shouldn’t have to do that, though, because this is in the “you had one job” category for baristas.
The lady who won so much from McDonald’s was White. Has nothing to do with color.

I would imagine that at some point the companies that insure DD and the rest of the places with drive though hot drinks will require them to lower the temperature of these drinks. Customers won’t like it, but this is the price you pay for having lawyers around every corner.
