Your first questions make sense. You need a condition of war to execute the Laws of War. Only then do we go beyond “Who’s on First.” Attempting to execute the Laws of War in a situation where it isn’t obvious that there is war only divides the citizenry and the military, making it impossible for them to accept the situation and act upon it.
Right now, we have no conditions that would permit the military to take over. The election mess is not sufficient. Open warfare or a foreign occupying force within DC would be sufficient.

Publius, I can’t remember if you said you have read Patel Patriot’s Devolution series or not. If you have not, would you consider doing so? His series gives ample evidence for the use of the military in my non-scholarly understanding, I have read all of his articles.
And here is a link to Majic Eyes Qnly, Law of War series. Some of the videos explains the Law of War manual from 2015 and how it relates to current events, and why it provides for military intervention. I haven’t seen all his videos by any means, just some.

Arizona Primary August 2 I believe. September 3 is cut-off date for 2020 election data. IMO the AZ AG is betting he can pull the wool over AZ Republican voters to win the August primary and then not press the election fraud issue letting the September date pass, then he can blame the legislature for not doing its job of decert and his hands were tied. On the flip side the AZ legislature is playing the same game saying they are “waiting” for the AG to file charges and when the same Aug and Sept milestones pass, they will blame the AG when no decert saying I tried but the AG didn’t do anything. Playing the same game they have played forever, thinking the voter for being a sucker.
When in reality the legislature can decert without the AZ AG.
They are playing the AZ citizens with the same three card monty shell game they always play on the voters.

The problem is that you would need an overwhelming desire on the part of the people to remove the current government. With half the people still believing every word uttered by the Mainstream Media, you have this massive blockage that prevents action. You would need the MSM to throw in the towel and finally report the truth.
The closest thing we have to that is the realization that Biden can no longer play his role, his VP is useless, and that his party is headed for defeat and splintering this fall. That can easily be addressed by a paper shortage and total reliance on (easily hacked) electronic means. The enemy still has cards to play.
Devolution is not just a back-up plan “in case”.
Look back to Reagan’s assassination attempt and what Al Haig said that day when POTUS could not execute his duties (he was sedated) and the VP could not be found.
Devolution is actual Command Control of the US military.
Which is the ONLY way.
Now, describe 3 scenarios when Military Command Control would be invoked (devolution as standing orders).

Now give me 2 more but keep in mind, Devolution is about “Military Command Control” not Executive control of the government.

The problem is that we not only have two presidents, but we have two militaries.
The Perfumed Princes of the Pentagon are members in good standing of the Deep State and support Biden. They will do nothing to endanger their retirements, their seats on the boards of directors of defense-related companies, and their lakeside dachas paid for by the defense companies.
Many below them follow Trump, but the military has its own way of enforcing orders. We've never had a mutiny in our history since adoption of the Constitution.
If Trump publicly laid out the evidence, the Mainstream Media would go all out to prevent a change of government to the point of fomenting civil war. The Perfumed Prices would be right in the vanguard of this effort. Trump and his military would have to shut down the MSM and even the Internet. This would be totally outside the Constitution and would reek of a banana republic coup. Many supporters of the Constitution would feel required to join the Deep State.
If the goal is to mimic England's Glorious Revolution of 1688, rather than the English Civil War of 1649, the dam has to break somewhere, and the truth has to be widely known and accepted. While nervousness within the Deep State about Biden's future is a factor, no one wants to tell the whole truth yet.
