Oklahoma to lose National Guard status… Will be called State Militia instead…

I was a member of a state police SWAT team. I was issued a selective fire M4A1 Carbine. Even though I kept it with me at all times, it was the property of the state. It was purchased by the state directly from the manufacturer with no requirement whatsoever for compliance with the NFA of 1934, or the subsequent Hughes amendment of 1986. Many automatic weapons and “destructive devices” are owned by, and issued to employees of the state, without federal regulation as to their possession by same.

The individual states are sovereign governmental entities under the constitution of the US. Short of nuclear weapons (which no NG units are equipped with anyway) The state is free to purchase ANY item of ordinary military equipment, to include armored fighting vehicles, attack fighter aircraft, etc., from any contractor or arms dealer that they are willing to budget and tax their citizens to pay for.

Yes, if the Pentagon decertifies the OK NG, they will be obligated to return all federal property of the US govt. (I refer you to that little dust-up over the status of Ft. Sumpter after the Confederacy seceded) OK might negotiate with them for the retention of said equipment, but if the US govt refuses to do so, nothing in the constitution prohibits a sovereign US state from arming and equipping it’s own armed forces in a manner consistent with the normal armament of a modern military force.

This was what every state with a militia routinely did prior to Congress passing the Dicke Act of 1903 which created the National Guard, which obviously did not exist before then. Much of the gear (cannon for example) was often privately owned.

Remember, Article I, section 8 of the constitution gives the authority to the CONGRESS to call the state militias to federal duty, at which time they are under the command of the POTUS as C-in-C, at which time Congress may prescribe their manner of organization, discipline, equipment, and training, but only when in federal service.

Snark is not an argument.

A state has a completely different mission for its militia than fedgov does for the national guard. Also, fedgov is absolutely obsessed with wasting as much money as humanly possible, and the defense department may be the worst of all the federal departments.

States would neither be replicating the mission of the national guard, nor replicating that absurd waste.

It seems to me that this administration is bent on decimating the armed services anyway. They’re trying to enforce mandates, but that in itself is going to further reduce our armed forces. They’re fighting both sides of the same coin, to weaken and damage our military. And for Oklahoma to do this, is a plus for them; they’re going to have their cake and eat it, too. The contempt I have for this administration is boundless; they are actively and purposefully destroying our country. LORD have mercy on us all.

Becoming a state militia means a huge loss of federal money, no longer getting DoD equipment, etc.. so it's not just no longer being under federal control - it also means no more federal support.

You're 100% correct. This is basically the nuclear option for the DoD, and for the Oklahoma NG.

A militia cannot have modern class three military grade weapons such as full auto and post 1986 belt fed machine guns nor any destructive devices without a $200 stamp for each and every round, nor armor piercing ammo. They also cannot have Abrams tanks, MARPS or fighter jets think air national guard

Sounds like we need to send the ATF to collect the Afghan arms.

Try buying 40mm M203 rounds, or 9 mm black tips. WWII era black tip 50bmg or 30/06 rounds are specifically except. You also cannot have 5.56 black tip because of their capability of use in pistols of 5.56mm the green tips again atf exempt. You also cannot have 60’m mortar rounds nor 120 mm Abrams tank rounds and nether can the state militia only Federal level forces get the big boy toys. If you have a M2 that is full auto and it’s newer than 1986 on the receiver and you are not a class 7 or class 3 ffl enjoy the stay in Club fed. State militia will not qualify for class 3 so every one of those grade weapons will have to be returned to the Fed’s.

The argument over if the Fed’s will use the military on the state’s was settled in 1865. I point out what the Fed’s will likely do because history supports that position. Don’t blame the messenger any one who understands history can see the Fed’s will push and shove if need be. Question is will people actually leave the keyboards and risk the mortgage and missing off the soccormom wife to do anything about it. Make no mistake the Fed’s are playing for keeps just like 1865 they have proven at Waco, ruby ridge to name a few that they will push hard and kill Americans in national media no less. Let see how froggy OK boys are my bet is no one jumps but lots will bang and bang at the keyboards. Wake me up when the rounds start going down range then I’ll believe the keyboards commando Army has risen to the challenge. The state’s are addicted to Fed money and with that comes strings attached. As pointed out the state if OK could apply to get class 3 weapons such as for swat team members but they also have to fund, licence and train said members and they still have to get ATF approvals to transfer said weapons to the agency from the class 7. I would imagine the Fed’s just saying nope and we will arrest anyone who makes a not approved transfer or takes possession. They already can demand all the existing equipment back.

Afghan ? Really that’s the straw man you choose. We provided foreign troops who formerly were under our training and diplomatic umbrella with arms then we chose to turn tail and run leaving all the equipment behind and some how a domestic only charted agency is going to be tasked with recovery of said assests surely no one is that bloody stupid. The US government could care less what the Afghan forces have now that we tucked tail and ran.

Seriously, talk about the pentagon shooting themselves in the readiness foot...regulars are not able to deploy without reserve/guard call up, the navy possibly being an exception.
