A Texas woman is suing Starbucks over first-degree burns she suffered, claiming she was given the wrong coffee and then spilled it on herself when she gave it back, court papers say.
Mary Simms ordered some joe on April 14 from a Starbucks drive-thru in Tomball, Texas, according to the suit filed in Harris County, Texas.
The employee informed Simms that she was given the wrong drink and when Simms stopped her car and handed back the coffee, the lid came off and the coffee spilled on Simms’ lap.
“As a result of the spill, [Simms] sustained first and second-degree burns causing severe personal injuries and damages,” the suit says.

Lawsuit lottery!
If it is hot enough to burn you then the MacDonald’s suit might be precedent.
The McD suit was actually righteous. The coffee was so hot it caused 2nd degree burns. That is too hot for your mouth so I do not understand that anyway.
There is some level of ‘assumed risk’ that will be considered here by most judges. Stuff happens. It’s not always criminal negligence or ‘evil’ cashiers.
Tomball anywhere near Houston?
We need to adopt the system used in other countries where, if you lose, you must pay for the defense’s attorneys fees and all court costs.

Yes, it is a suburb of Houston. Fun fact: Tomball is named after an important Houston lawyer, Thomas Henry Ball.
The famous McDonald’s lawsuit was not righteous. The burns were second degree because the woman held the cup between her legs, the pressure popped the lid off and the hot coffee rolled down her lap and cooked her crotch. The burns were severe. But in the end she spilled it on herself and as another FReeper said some risk are “assumed”. “Hot coffee” does not mean lukewarm coffee.
She would not have bought cold coffee. Being hot enough to be desired was a feature they were seeking out.
Just as with those McDonald’s lawsuits this should be thrown out … but it will not be,
I despise Starbuck’s because of their politics. I’ve spent less than $20 there in the last 10 years. But I have to admit their cold brew is pretty damn good.
It was that hot because it needed to still be hot when they got to where they were going.
They would not have bought the coffee if it hadn’t been that hot.
Bad things happen and it’s no big deal.
I almost never go.
