If it is hot enough to burn you then the MacDonald’s suit might be precedent.
The McD suit was actually righteous. The coffee was so hot it caused 2nd degree burns. That is too hot for your mouth so I do not understand that anyway.
The famous McDonald’s lawsuit was not righteous. The burns were second degree because the woman held the cup between her legs, the pressure popped the lid off and the hot coffee rolled down her lap and cooked her crotch. The burns were severe. But in the end she spilled it on herself and as another FReeper said some risk are “assumed”. “Hot coffee” does not mean lukewarm coffee.
It was that hot because it needed to still be hot when they got to where they were going.
They would not have bought the coffee if it hadn’t been that hot.
Bad things happen and it’s no big deal.

Coffee is brewed at 195°-200° to get the best flavor out of the coffee. According to experts if the water is cooler than 195° the brew will be flat or even sour tasting.

Some sources say the best DRINKING temp for coffee is 145°. Still hot but that cup of Joe has to cool 55° before imbibing. That takes a minute.
LOL, memo to myself: coffee is Hot. NONE of these class action lawsuits are "righteous".
I looked up and read this lawsuit. The only part that I think may go anywhere is the claim that there was something wrong with the lid that caused it to pop off. Starbucks changed the material on their lids a few years ago, and they are harder to keep on. But that's still pretty weak.
McD case had third degreee burns and five-or-six-figure medical treatment.
1st degree is redness
2nd degree is blisters
3rd degree is “burn the meat.”
