I have a question for the experts and well-read on the subject of medical privacy. Will providers and insurers be prohibited under HIPAA from disclosing whether or not you have been vaccinated against the Coronavirus? I’m asking because the writing on the wall seems to indicate that one’s “vaccination status” will likely be the next level of Fascism coming after masks. Already, airlines are being queued up to scrutinize the “haves” and “have-nots” for fitness for boarding.
I realize that one of the main reasons for HIPAA’s enactment was to provide cover and its resultant increase in power to a political group most profoundly responsible for AIDS. Therefore, I can see a lot of carve outs being granted for the same political decisions.
If you give written permission, the provider can disclose if you have been vaccinated against this virus. That could easily be part of what you sign when you get the vaccine, that you give them permission to report that you got it. I assume you have to sign something when you show up for the vaccine. This may be in the release already as far as I would know, not having seen one.
In NJ there are signs at the entrance to most (or all?) stores that say that one must wear a mask to enter. A woman who was walking around my friend’s store without a mask. When she was asked to put one on, she replied that she didn’t have to wear one because of a medical problem. So my friend asked for some proof of this medical problem. This wound up getting him in all sorts of trouble with the State Attorney General. Asking about medical issues is apparently a touchy issue, at least in NJ.

No entity “violates HIPPA” by asking for info. HIPPA is violated by an entity that makes an unauthorized release of medical info. The only entities that would have this info are health care and insurance entities, the point of the OP
Read everything you signed online. You pretty much waived any privacy rights when you signed up. In Texas, it is going on a statewide registry, and info is also going to the feds as I recall. The list of who was getting your medical information was fairly long, and I don’t recall everyone who would have routine access.
I ended up not signing up for the county list before they shut it down. But I did read the releases.

HIPAA means your provider and insurer can’t disclose without your permission. It doesn’t mean some other service provider can’t demand. Really it’s no different than your MMR. Can’t go to most schools without being current.
HIPAA can be broken in certain snd very specific situations as in the duty to disclose harm or threat to others. The government can enact emergency health measures to stop disease spread (forced quarantine for example) but this applies to active disease
There is nothing that compels someone to disclose vaccination status. However a private company can require whatever standard or want to employ or provide service so long as it does not violate specific protected individuals (title IX?). So I suppose that an airline as a private entity can require to prove or declare vaccination status. It’s the price of freedom and private companies.
HIPPA exists to advance the interests of the state.
I think your analysis is spot on with this issue. I don’t see the Supreme Court siding with freedom on this. And I absolutely am against compulsory vaccination. I think anyone should be allowed to chose what’s best for them on vaccination and understand the risks or and of not being vaccinated. As far as I see it the unvaccinated person assumes the risk of getting the disease
What I am also concerned about is the weasel plaintiffs bar running around suing the crap out of companies if some one contracts the virus. It’s a double edge sword.
But Robert’s will indeed screw us and I am not sure ACB is much better so far.

In the State of Georgia, a runoff elections is considered a CONTINUATION of the primary that preceded it. If you were NOT registered to vote in time for the PRIMARY you CANNOT vote in the RUNOFF.
Georgia kind of disregarded that.
I took the Pfizer vax in North Texas last week. They scan your ID the QR code and bar codes in the back which contains your thumb prints and picture in digital form in Texas then they scanned your entry barcode which is your unique County level vaccination it number then they scanned the vial of the vaccine which had the manufacturer and batch number on it. The card that u are provided with proof of first dose also has all those numbers on it and a place for the second dose information. And yes absolutely the signed release had that the County can keep all that information in a database and provide it to the state health department on request. Why would anyone think vaccination would be anonymous is just crazy. They are required by Federal law to record this as well and that stands for all other communicable diseases such as polio , TB, smallpox, measles all those vaccines are also reported to the Fed’s.
Point two as was pointed out by some intelligent FRiend up thread hippa was passed to do one thing protect the gays with aids from being dropped or denied insurance or jobs. The limits apply to “covered entities” contract carrier’s such as airlines are specifically not covered by that law nor are your employers my last corp job required people to take yearly health screenings for insurance coverage they did the screenings not the insurance company to get around Hippa. Smoking was an extra $100 per person per month and they blood tested for nicotine, being over weight yup another hundred. High BP not on medication for it $100 all perfectly legal and Texas is a right to work state refuse and they can let you go for no fault you just are not needed any more you cannot use them for that people tried they lost and in Texas you pay the other sides legal expenses if you lose a civil suit. Freedom.cuts both ways we don’t get forced into unions but employment is purely at their will because of that.
This is about taking your guns. Think about how a vaccine database can be mined. “ We know you took the vaccine. Who didn’t?” After that a little further datamining, the government can create a fake far rightwing militia group, attach those names to it and begin investigations. Chances are they will find weapons. There is a reason the White House should now be called the Reichstag.

Not just MMR, I returned as an adult to get a second master’s and a PhD years after my MMR and meningitis vaccines expired. The University required proof of both in the last ten years to even set foot on campus as a student or faculty member of which I was both. Being a lecturer and a student at the same time. I pulled my military vax records which had my meningitis and had to get at the sstudent health Center a booster for MMR , I also got the TDAP the same day along with quad valiant flu. Stackem and packem. That’s still nothing compared to walking the line in MCRD San Diego with corpsmen on both sides with CO2 guns hitting you with at least 20 vaccines in about 5 minutes I remember being falling out sick on the evening run and my arms and body was so stiff the next day during PT I could barely do push ups. But we drove on like men who were eventually have the privilege to be known as Marine’s and didn’t whine like little brats about shots.

Forget precheck had if for 5 years let it expire. CLEAR is the way to go for sure. I fly normally 25+ times a year half of that international. With CLEAR they scan your iris and then they walk you to the front of the line past precheck and to a dedicated body scanner line. I have never arrived to an airport more than half an hour early and usually pass through security in under ten minutes most of the time under 5. It’s $175 per year for CLEAR they are a “private” security group the TSA has hired its for the upper middle class and higher to buy privilege and it is worth EVERY PENNY best $175 bucks that could be spent if you fly a lot expense it as T&E if you are a small biz or get your Corp to comp it as T&E. You won’t regret it. Thanksgiving 2019 on the day before turkey day at DFW the line for security was out the area and down the concourse and at least 2.5 hours long. The CLEAR line was 20 people deep.and only because they were signing people up right at the eye machines with credit cards. Even with 20 people they walked the entire group past the 2 hour line to the scanners and we were all on the other side in 10 mins. Such the win.
Heh - thanks! I would go for that but I fly out of a smaller market that doesn’t have Clear in their airport. (Though I’ve seen it in the larger ones)
