It's clear the impeachment managers, realizing they don't have the votes to convict because Trump's speech could not have incited a riot that was pre-planned, are now alleging, equally without evidence, that Trump was in on it all along. Wouldn't this require the House to re-impeach since incitement doesn't fit the newly uncovered evidence?
I’m not sure this would be the case. If a prosecutor files a murder charge and accuses the defendant of shooting someone, does he have to re-file the case if it turns out the cause of death was blunt force trauma but it was still caused by the same perpetrator?
No, this is a different charge.
This is more like filing burglary charges, then finding out a murder had taken place in the store.
You cannot piggyback one charge on an existing one.
In your example it is the same CHARGE, just a difference in method.
I would prefer a 3rd impeachment and hopefully more to follow. IMO the best use of the House’s time for the next 2 years.
Good point - if this process was consistent with reason and logic. And Constitutional law. But, as we know, it’s purely political. The “prosecutors” aren’t even pretending to adhere to any of the usual safeguards or protocols of a criminal court case. The jurors aren’t impartial; they’re a group of politicians. But, again, your point is well taken.
Will they care? I think the legislature just want to pass a bill which punishes a citizen they don’t like. They don’t seem to worry too much about the details.

Once a D.A. has filed charges against someone, they can amend those charges as the evidence allows. They don't need to go back to a Grand Jury to get additional indictments.
That is not true of the House Managers. They are there only to prosecute the Articles of Impeachment passed by the house. They can't willy-nilly add additional scope to the chagres on their own volition.

Don’t think they care either. But it’s been obvious from the start that impeachment is just a desperate gambit to keep Trump’s name off the ballot in 2024. With the emerging evidence conflicting with the managers’ original narrative, it makes conviction all the more a long shot. Thus, the need to re-impeach in the hopes of bringing more RINOs on board. Of course, it would be a nakedly desperate move, but desperate times ....

That, plus your point about shifting goslposts, seems clearly to indicate the Senate is targeting a private citizen without a court trial and without due process. It seems to be attempting a bill of attainder.
