I’m not sure this would be the case. If a prosecutor files a murder charge and accuses the defendant of shooting someone, does he have to re-file the case if it turns out the cause of death was blunt force trauma but it was still caused by the same perpetrator?
I would prefer a 3rd impeachment and hopefully more to follow. IMO the best use of the House’s time for the next 2 years.
Will they care? I think the legislature just want to pass a bill which punishes a citizen they don’t like. They don’t seem to worry too much about the details.

This is a political kangaroo court. It can do anything it wants to do.
What is strange to me is that the Trump lawyers haven’t even pointed out the obvious:
The charge is a crime against a private citizen yet the Senate has taken it upon themselves to usurp the authority of the Judicial Branch (courts) and try the crime within their political body.
The Senate, voting that the Constitutional proscriptions don’t apply in this specific case have wholly negated, not just the 3rd Article, but the entire Constitution.
Under this new understanding, “peaceful assembly” (confronting lawmakers) and redress of grievances (”stop the steal”) are now subject to trial by Senate, not a jury of peers.
This broader interpretation of the “rules” WILL allow your arrest at any townhall meeting where you demand action from your elected official.
I suggest you request “trial by Senate” for any federal crime you commit.
Maybe for any federal charges that result?
I think they should keep impeaching and trying Trump over and over. That way, they won’t be able to pass their gun grabs, amnesties and tax hikes.
And Trump should not show up for that one either.
