What if Pence resigns???

According to the constitution the President of the Senate, vp Pence, presides over the electoral vote on January 6.

But what if he resigns instead? Right then and there. There is no President of the Senate then.

So what is the constitutional remedy and what do you suppose will happen?

What if games. Hmmmmm. What if Biden keels over dead in the next two weeks. Kamala couldn’t be sworn in because she was not elected to the office. So would Trump continue until a special election were held?

If, and I say if, VP Pence were to resign then the President Pro Tem of the Senate would administer the joint session. That would be Charles Grassley. As for replacement of a resigning VP, look no further than Spiro Agnew’s resignation. The Senate would have to approve any replacement.

Why would he go through such extreme upheaval whrn dottery Uncle Joe is going to be “coronated” in three short weeks anyway?

If Pence and Trump are at odds, the easiest solution is for Pence to stay away from the Oval Office as much as possible.

I suspect that the race the day before may not be decided by the time of this vote.

It doesn’t really matter whether it is a Dem or a GOP counting the votes..the process is the same.

Congress is going to decide this mess. They will debate after the objections...and then we get President Biden.

Free Republic is supposed to be place where we can hold discussions about these things without people treating you like you are stupid for asking questions and asking what ifs. Ignore all the “it aint gonna happen” stick up their ass crowd.

If NO resignation and Pence does NOT show up on January 6 2020 then Senate President ProTemp Chuck Grassley would act in his place. Not certain how that would work, but he is quite aware of the efforts of the FBI and DOJ to take Trump down, probably also aware of the Electoral Fraud.

I am not absolutely certain, but if the VP resigns BEFORE the electors meet his party may substitute a replacement and then the electors votes for Pence would count for the replacement. (Pretty sure.)
Resignation after the electors meet the 25th amendment would apply and both houses of Congress would need to approve a replacement. The President Pro Tempore would be acting VP until that happens.

If Vice President Mike Pence chooses not to attend the joint session, Republican Senator Chuck Grassley of Iowa, president pro tempore of the Senate, will preside.

There have also been several occasions throughout American history where a Vice-President vacated the office. Prior to the 25th (?) amendment, the office remained vacant until the following election. So I would think there would be several instances of precedent to look back to.

Don’t count on Chuck Grassley. He says this has been a great election with no fraud. He is perhaps the most tenured “deepest state” tool out there (not to mention Diane Feinstein)
