In doing so, the court rejected a rare challenge by the state’s attorney general, Xavier Becerra, whose office normally represents county prosecutors when their cases are appealed...
Becerra, tapped by President-elect Joe Biden to head the U.S. Department of Health and Human Services...said that fear of prosecution may prevent pregnant women from seeking addiction services. The case could also prompt extra scrutiny by law enforcement on miscarriages and stillbirths, he said.
Chelsea Becker of Hanford has been in jail on $2 million bail since the September 2019 stillbirth. Police say methamphetamine was found in the fetus and that Becker, who was 8½ months pregnant at the time of the stillbirth, had admitted recently using the drug.
A 1970 California law allowing murder prosecution for intentionally or recklessly causing the death of a fetus does not say whether the pregnant woman herself can be charged. But it lists circumstances that would bar prosecution, including legal abortion, medical intervention to save the woman’s life, or any act that was “solicited, aided, abetted or consented to by the mother of the fetus.”

She is guilty of course, but its a twisted legal pretzel abortion has made of legal rights.
Women have a right to abortion, but if they take meth and it kills the child they are guilty of murder.
Methadrine overdose - a wicked way to die. For anybody, worse for an infant in utero.
Practicing without a license will not be tolerated.
The way I read the "exceptions", it would depend upon whether she did the meth with the intent to kill the fetus (that's "legal"); or if she accidentally/recklessly killed it without intending to by taking the meth (that's "illegal").
By the same logic, it's legal for her to 'solicit' and 'consent to' her baby daddy kicking her in the belly to intentionally kill it; but it's murder if he does so without 'her consent'!?! Either way, it is methed up legislation.
Come on man, she was just aborting the child. (waiting for that to be raised as her defense)
Another case of medicinal methamphetamine use here.
How do you murder an unviable tissue mass? Is that not already settled law by the Gutless Court of Supreme Whim?
They are both murder but this is not about that. It is about keeping the population back on its heels and creating conundrums. The more things are mixed up the easier it is to institute communism.
Medical meth is actually legal in all 50 states and can even be prescribed to children if any doctor wants to.
Pharma brand name is Desoxyn and typically is prescribed for weight loss or attention disorders (”ADHD”).
Opiods far stronger than heroin are made by big pharma and can be prescribed for things like a toothache.
Psychotropic drugs like ambien/xanax which have caused murder, psychosis and accidents can be prescribed for “insomnia” or “anxiety”.
Yet big pharma has convinced nearly half of this country that doctors prescribing cannabis would lead to the end of society...
So, if she drives drunk on her way to the abortionist, has a wreck and kills the baby, can she be prosecuted for killing the baby?
If she is driving to an abortionist and a driver runs a red light and kills the baby, can he be prosecuted for killing the baby.
The “right to chose” allows her to get away with murder, but the other driver WILL be prosecuted—insanity.
And anyway, it’s HER body. If she wants to put drugs in it why does a MAN get to tell her what to do with HER body!?
Isn’t that the logic. If the fetus is not a person and can be ‘terminated’ at the will of the pregnant woman, then why can’t she also just abort by meth?
It’s all based on a sick twist of logic from the get go. Abortion is murder and twisting it around like they do with the abortion laws is pretzel logic.
If this woman can even be charged with murder, doesn’t that necessarily imply that the victim is a human being with the right to not be murdered?
In a normal world, yes, but given the trimester argument surrounding when abortion is legal, I’m guessing that she’s being charged because the child could have survived outside the womb.
