The way I read the "exceptions", it would depend upon whether she did the meth with the intent to kill the fetus (that's "legal"); or if she accidentally/recklessly killed it without intending to by taking the meth (that's "illegal").
By the same logic, it's legal for her to 'solicit' and 'consent to' her baby daddy kicking her in the belly to intentionally kill it; but it's murder if he does so without 'her consent'!?! Either way, it is methed up legislation.
