This was my sister's family Dr. Office response in upstate NY regarding her question for use of Hydroxychloroquine as a treatment for Covid-19.

We understand you may have questions about these medications. While President Trump has in the past said we should be rolling out these medications, they aren't readily available for our patients. Cuomo's executive order stipulates that no pharmacy may dispense hydroxychloroquine for anything other than an FDA approved indication outside of a hospital or clinical trial. At the present time, COVID-19 is not an FDA approved indication for this drug. Even if our providers wrote the script, the pharmacy would not fill it. It's reserved for hospitals/clinical trials. I hope this helps. The future will bring vaccines, treatments, and enhanced rapid testing for this disease. We remain hopeful.

Gee. Pretty clear explanation: Cuomo hates Trump, and is determined that NOTHING Trump has said or ever done or recommends will be permitted.
Seems like a measured and reasonable response.
Having said that, I live in NY and one thing health-care, police, and any government bureaucrat are really good at is statist bureaucracy, and telling you how/why you CAN’T do something.
It must be comforting to live in a state whose governor is so well-versed in medical treatment of the Wuhan China virus that he directs which treatments doctors can prescribe to his state’s citizens. You must feel blessed.
So Cuomo is willing to get people killed to feed his TDS and lust for power. If he is a murderer, he should be treated as such.
Fortunately for me I live in the state of Texas were no such restrictions exist and where our governor would never insult himself between a doctor patient relationship.
I can tell you my sister is livid to the point of tears.
What neither of us understand is how any politician can direct any doctor what FDA approved treatment, off label or otherwise, should or should not be administered to one of their patients.
Is this even legal?

A couple weeks ago I pinged an online doc service just to see what would happen. Same response. Reading between the lines, the docs don’t like it, but their hands are tied. (Even though on the side they probably have created or are already using their own private stash.)
Can the Gov be sued by the estate of a person denied early treatment who then goes on to die??

I think this applies to the emergency national stockpile only and also can be used only for hospitalized patients in general.
Our doctor in Texas can prescribe HCQ (plus AZ)for Covid cases On an outpatient basis when the prescription is available to be filled by a local pharmacy and not from the national stock pile.

There are about 20,000 grieving families in NY right now who have lost loved ones that didn’t need to die- I’m willing to bet almost all of those fatalities could have been prevented had the victims received early treatment with HCQ-
The power grubbing elites will all get HCQ if they get the virus- but the poor folks who vote for them won’t- and didn’t get it- and died!
Imagine for a moment if the roles were reversed- and, God forbid, cumo was president and Trump was gov of NY as a republican, and Trump refused to allow HCQ and 20,000 or so folks in NY died as a result- Trump would have lost his job long before now and would be facing charges-
But because cumo is running NY, the msm are silent about 20,000 people dying as a direct result of the heinous EO that forbids pharmacists from filling the orders-
you sister should write them back and ask why NY’ers are being denied a drug that is saving 1000’s of lives during this pandemic? The FDA hjas declared that patients have the ‘right to try’- and ask why cumo has the power to over-ride a federal dictate that is saving lives?

Yep. Totally. And even if it's not, there is no effective remedy for the government breaking the law. Courthouses are repositories of evil spirits. The only peole that thrive in there are judges and lawyers.
