Can President Trump recess appointment to the Supreme Court?

Think October 29th, President Trump using recess appointment to install Brett Kavanaugh on the Supreme Court. He could be on the court for up to two years.

This appears to be allowed by the Constitution.

Lousy idea to do a temp appointment. He’ll get approved anyway.

I think Flake is feeling a lot of blowback now and perhaps this has been good for the GOP and made a lot of people realize that nourishing vipers in the bosom was not a good idea. For too many years, grandstandrrs like McCain, Flake, Murkowski, etc have been tolerated. But why give them GOP money if they’re going to oppose GOP policies and candidates? I think this has galvanized the electorate (I.e., the contributors).

Napolitano is a moron. Who in their right mind is going to give up a lifetime D.C. Circuit Court appointment to take a recess Supreme Court appointment that may only last two years at most?

If Trump has to make a recess appointment for this seat, he will most likely appoint an older Federal judge who is close to retirement anyway. Better yet -- kill two birds with one stone by shaking the DOJ up at the same time. Put JEFF SESSIONS in that role.

If Trump took such action, it would be spun by the liberals and the media as a major abuse of power.

As opposed to the glowing positive praise the media provides Trump?

The Senate has so far has used ‘pro forma’ sessions to avoid going into legal recess specifically to prevent recess appointments. Doesn’t mean all the senators can’t go home as usual.

A few from close to DC have coffee together in a pro forma sessions once a week or so.

Let SCOTUS be tied, 4-4. Hence, no decisions, no changes.

The, after Ruth goes to join the 60 million who were deprived of their lives, the court will be 4-3, with a conservative majority.

And it can stay like that, as far as I’m concerned.

Wouldn’t that give the next President two chairs to fill? If the next President was a Lib, then the court would be 5 / 4 in their favor and the possibility of going to 6 / 3 over a Presidential term.

Pretending that a valid part of the Constitution is a “very bad idea” plays into the liberals’ hands.

My view on COS as well. It's there for a reason. Any part of the Constitution can be abused, and is abused and will be abused more by 'Rats. But, a COS is in the Constitution to fix things, and should be used to that effect. If we don't make use of it, we'll never get amendments that limit congressional powers due to conflict of interest.
