Two South Florida McDonald's customers think the fast-food giant is being awfully cheesy with how it charges customers for a signature item that has been on its menu since 1975.
According to a class-action lawsuit filed in Fort Lauderdale federal court on May 8, Cynthia Kissner, of Broward County, and Leonard Werner, of Miami-Dade, say they have had to pay for cheese they don't want on their Quarter Pounder sandwiches.
The suit asks for at least $5 million.
It comes down to this: On the menu, a hamburger at Micky D's is cheaper than a cheeseburger.
According to the lawsuit, filed by Andrew Lavin of the Miami-based Lavin Law Group, McDonald's used to sell four items in the Quarter Pounder family, with and without cheese, with prices adjusted accordingly about .30 to .90 cents more for cheese than without.
This practice continued for years, the suit says, but now McDonald's, "at some point," ceased "separately displaying these products for purchase on menus, and currently lists the availability of Quarter Pounder with Cheese and Double Quarter Pounder with Cheese."
As a result, the suit claims, "customers have been forced, and continue to be overcharged for these products, by being forced to pay for two slices of cheese, which they do not want, order, or receive, to be able to purchase their desired product."
Having to pay for cheese they do not receive because they asked that it be held off of the burgers, well, they are not "lovin' it," to borrow from McDonald's current slogan.

I was thinking the same thing. Go to the grocery store,hit the cheese aisle and you’ll see those packages of singles labelled “cheese food” a generous estimate at best.
The lawsuit would be more interesting if they were trying to force McDonald’s to label it Quarter Pounder with Cheese Food.
Seems they were able to pull an attorney away from ambulance chasing to engage him in this form of barratry.

I know some of the damage has been internally, through totally incompetent management and policies, such as getting rid of the beef-tallow and cottonseed oil used to cook the fries in, and introducing tons of menu items that has the original McDonald brothers AND Ray Kroc rolling in their graves (If you haven't seen The Founder, see it - excellent movie and Michael Keaton nails Kroc's character).
But just the last couple of weeks, there's been a sexual harassment suit against them, the stupid Fight for $15 movement, fights over chicken McNuggets, and now this.
McDonald's needs to do one simple thing: Just go back to the basics, Sell burgers, fries, milkshakes, and apple pies again. Get rid of two-thirds of the menu items and get rid of that Obama flunky who couldn't hold a press conference if his life depended on it.
What if I dont want ketchup? Should I have to pay for it?
Somewhere in the country, there has to be at least one brave judge to sit before these people and say;
“With all due respect, my only message to the plaintiff is this: “Your dispute could have been resolved by speaking with the manager or franchise owner. Get over it! And get out of my courtroom with this utter nonsense! I find the plaintiffs GUILTY of contempt of court, as illustrated by this frivolous lawsuit. You now owe for the court costs to you and to this restaurant!”
I never liked what McDonald's calls "cheese."
But 20 or 30 years ago they decided everything needed it.
"Cheese" on a fish sandwich or McGriddle is enough to gag me.

I dont know if destroyed is a word Id use. I bought their stock at around $90 and its now over $160. Their all day breakfast is doing well for them. And Ive noticed a distinct uptick in their emplyees courtesythis across several stores in several states. Almost as if theyve been watching Chick-Fil-A. Also kiosks are making an appearance in some stores.
In other words, it’s all about cutting the cheese?

The quarter pounder costs the same, whether it’s with or without cheese. You can get it any way you want, with or without certain toppings, but it’s the same price no matter what’s on it.
That doesn't equal long-term growth and prosperity. Stocks are cyclical in nature.
What is McDonald's doing to address structural issues? There are stories that Millennials aren't applying for fast-food jobs which is going to create employment shortages. And McDonald's is going to get buried by fast-casual places or people making meals at home.
If McDonald's go back to the basics, cut their prices, and stop appeasing the food police, they'll be #1 again.
