I'm not taking a position one way or the other, I have been watching the "Birther" controversy with interest.
In answering my question, please go further than the obvious, in other words what would be the outfall and how would you handle the eventual constitutional crisis? Would Biden become prez? If he is no longer viable, would it then fall to Pelosi?
I'm asking the birther supporters to think long range about this.
1. Under no legal standards can I envision a scenario where we would "go back in time" and re-do an election. The results of the 2008 election stand.
2. If it turns out that Obama is ineligible to serve as president, then his ineligibility stands from the moment it is determined. Joe Biden becomes president and he selects a new vice president in a manner similar to the process under which Ford became president in 1974.
If Barry broke federal law and committed a felony.....it would then be reasonable to proceed with impeachment.

Of course that opens up a whole other can of worms as to whether John McCain, born on Panamanian soil, is a natural born citizen. While a minority, there are those that say one must be born on US soil to be a NBC. Since NBC is not defined by the Constitution, that question could possibly end up in the hands of the Supreme Court.

That is a good point since there is no provision for invalidation due to lacxk of qualification etc...
You could state the same thing about allowing him to remain...

You are willing to employ a derogatory term to classify people who believe that there is a part of the Constitution that EXPRESSLY deals with this that was ignored.
The men who formed the Constitution didn’t put that in there simply because they needed another 500 words to fill out their 2000 word book report. They put that verbiage about who is elegible for the Presidency in the Constitution for a SPECIFIC REASON. The military, police and firefighters have processes and procedures that were written in BLOOD, which is why they insist (sometimes to the point of absurdity) that those processes are followed.
So it is with the Constitution.
It ISN’T just a piece of paper to use when you like it and discard when you don’t. It is the framework we have to LIVE OUR LIVES BY. I know many liberals feel that it is outdated, and apparently there are some Freepers as well.
I think it is disingenous of you to say “I’m not taking a position one way or another...” but clearly you have. At least have the courage of your convictions to say what you mean.
I agree with the other posters who opine that a ‘Constitutional Crisis’ is less critical than allowing this person to stay in office for 3 1/2 more years. I believe we should use ALL legal mechanisms possible to remove this man from power. If ONLY cap and trade and heath care are passed into law, our country is sunk. This says NOTHING about the appointment of radicals like Sotomayor and the ones to follow to the Supreme Court for life. Do YOU think it is worth just sitting back and letting the idiots in the Senate, the likes of Al Franken to act as a mature, reasonable and limiting body? Do you? Because if these pass the house, I have NO confidence that the adults are going to step in and put a stop to this legislation. And Obama is the person pushing it, driving it.
He should be challenged on ALL fronts. EVERY front. We OWE it to every person, who sacrificed both blood and treasure for OUR liberty since 1776, and we OWE it to our children and their children to fight this.
The Constitution MEANS something or it does not.
What is your view? You started this thread, but don’t seem very interested in responses to your inflammatory framing of the issue.

The U.S. Supreme Court actually botched the decision in that case, though the end result wouldn't have changed anyway. The only difference was that the justices in the majority got it completely wrong and the ones in the minority got it so far wrong that they have no business serving in any government capacity in the United States.
The basic point is that the provisions of the U.S. Constitution stand on their own, and cannot be undone regardless of the "extenuating circumstances."
I think Palin would clean Biden’s clock; but I don't see that as EVER being a likely matchup.
