CBS News correspondent Trish Regan reports that defense sources say Finnerty was eating at a Mexican restaurant when the alleged rape is said to have occurred. And they say Seligmann may not have been in the house during most of the time the alleged rape was carried out.
According to a neighbor's testimony, the stripper arrived at the house around 11:50 p.m., although the prosecution may argue she arrived earlier.
The defense says it has time-stamped photos of the stripper. The first was taken at midnight, followed by a series of pictures over the next four minutes that show her and Roberts.
There is a time gap in the photos of the alleged victim between 12:03:57 and 12:30:12, when she's seen at the back entrance of the house and appears to be leaving. A neighbor said he believes he saw her in the front yard sometime between 12:20 and 12:30.
Based on the time-stamps, there is a 16- to 26-minute window in which she could have been assaulted. But, during most of that time, Seligmann may not have been in the house.
Sources for the defense tell CBS News that cell phone records show Seligmann made calls at 12:07, 12:09 and 12:11. At 12:14, he called a cab to pick him up. Driver Moez Mostafar says he got that call and showed CBS News his dispatch records to prove it. He says he picked up Seligmann at 12:19.
"He looked normal, nothing looked unusual to me," Mostafar said. "He asked me to go to Wachovia Bank where he can get some money.

The most shocking thing we heard today was on Dan Abrams' show; evidently the lead detective in the case called the reporter on our local NBC17 and asked HER what was in the pictures she saw; like, did she see any kind of shoes, what kind of cars were there, who else did she see in the picutre.
Dan Abrams was just blown away; he says it sounds like they STILL don't know who was at that party. (And Dan was a little miffed that the detective didn't call HIM to ask him what he saw in the pictures.)
12 a.m.: This is the first picture of the strippers. Students are watching the show, but not grabbing or attempting to touch the women. Bruises are clearly visible on the legs and thighs of the alleged victim.
12:00:40 a.m.: Another picture taken 40 seconds later shows bruises on the accuser’s knees. Her right knee appears to have an open cut.
12:03:57 p.m.: About four minutes after arriving, a picture shows the strippers leaving the room. The photo clearly shows that the alleged victim left behind one of her shoes.
Between 12:10 a.m. and 12:30 a.m.: No photos were taken between this time.
12:30:12 a.m.: The next photo shows the alleged victim on the back porch, carrying what appears to be her purse and a makeup bag. Her clothes are intact.
12:30:47 a.m.: A photo taken 30 seconds later shows the alleged victim on the porch and she appears to smile.
12:31:26 a.m.: But 30 seconds after that, a photo shows the alleged victim stumbling down the back steps of the house.
12:37:58 a.m.: A series of photos are taken, all showing the woman lying on her left side on the back porch, seemingly passed out or asleep. She had visible cuts on her legs and buttocks that did not appear in the previous photos.
The cuts may be from falling. The cuts on her buttocks line up with the edge of a screen door she may have hit on the way down.
12:41 a.m.: The final photo shows the accuser and the second dancer in a black car. The accuser is in the passengers seat.
Now we know why the pictures are so cropped... and some not released at all...
they're probably sparing no expense to identify #3 from those two feet next to the white shoe....

Don't laugh; this story is getting THAT crazy.
You may be right. When I first saw her pictures on TV, I noticed that she had a tatoo. Then it was gone when the photos were posted on the Internet.
Yeah, but he's gone so far out on a limb, hitching his wagon to her that there's no turning back. The gutless wonder doesn't have the balls to admit he has doubts, maybe made a big mistake.
(Then I remind myself of the posters at CTV who STILL believe that this creature was raped.)
They've gone so far out as well that I think they're too embarassed but defiant to back off, and are just pretending to save face. Or else some of them might have some real issues with men that they readily believe the boys could do this.
The DADA does not care whether any of these guys are guilty of this or not. He is so dumb he likely believes he had to have an arrest to have any chance in his primary. Of course what he really did was sew up last or 3rd place.
As far as various feminazis around the net who believe or claim to believe these guys are guilty, well it is all politics to them and they do not care about justice.

During the Cody Posey trial you should have seen the posts on CTV supporting him. Many would give heart tugging stories of their own abuse as a kid and they "understood" why Cody killed his family.

*DURHAM* -- Now that state and federal agents are looking into
allegations of wrongdoing surrounding the *Durham* *Police* Department,
everyone from City Hall to Main Street is breathing a sigh of relief
that outside agencies are finally entering the case.
District Attorney Ronald L. Stephens has called the SBI into the
investigation involving allegations that a *prostitution* ring operated
out of the *police* department and the handling of an in-house probe of
the charges. He's asked agents to look at possible obstruction of
justice, intimidation of witnesses and even perjury involving the
complex case.
"There needed to be someone totally independent to come in and in a
professional manner review all of this and make some determination on
substantiated facts as to whether things were done appropriately and
legally," Stephens said.
*Police* Chief Trevor A. Hampton says he also has asked the SBI -- as
well as the FBI -- to enter the case.
On Friday, City Council members said it was time outside investigators
came onto the scene. "I think it will raise the comfort level of
everyone involved," said member Sylvia S. Kerckhoff.
Others said the *police* department should never have been investigating
itself in the first place.
"Hindsight is 20-20," said Mayor Harry E. Rodenhizer Jr. "We were not
aware of the first two investigations. But I would have been in favor of
an outside investigation from the start."
An internal investigation was conducted over five weeks late last year
by officers from the force's own organized crime division. That's when
allegations of the call-girl operation and other sexual misconduct
surfaced, but no criminal wrongdoing was uncovered.
The department's investigation focused on five employees, including
Wiley Davis Jr., former career development manager, who resigned earlier
this week amid allegations that he falsified his academic credentials to
attain his city position.
But some have speculated the investigation may have been compromised
from the very beginning. It started out in the department's own
professional standards division and then was handed over to the vice
officers.
Hampton has said the vice officers may have violated federal laws by
making some procedural errors during the probe. But Capt. George B.
Hare, who leads the vice unit, has staunchly defended his investigators.
And on Friday, he welcomed the outside agencies into the case.
"It will get a fair review," he said. "I have a lot of confidence in SBI
and any federal investigations. So far, the chief has been in full
control of information presented to the City Council and the public.

Meanwhile, officers on the street said morale has already started to
rise with news of the pending investigations. During the past three
weeks, some officers have said it was hard to
concentrate on doing their jobs.
"This has been an explosive issue to everyone," Hare said. "Maybe with
the SBI, we can get things back in perspective and get back to what
we're supposed to do."
Beginning early next week, several agents will start reviewing documents
and conducting interviews at the department.
"I hope it won't take long," said SBI director Charles J. Dunn Jr. "But
you never know until you get into it."
