Flip-Flop In Duke Rape Scandal (Source: Timeline Supports Duke Players)

CBS News correspondent Trish Regan reports that defense sources say Finnerty was eating at a Mexican restaurant when the alleged rape is said to have occurred. And they say Seligmann may not have been in the house during most of the time the alleged rape was carried out.

According to a neighbor's testimony, the stripper arrived at the house around 11:50 p.m., although the prosecution may argue she arrived earlier.

The defense says it has time-stamped photos of the stripper. The first was taken at midnight, followed by a series of pictures over the next four minutes that show her and Roberts.

There is a time gap in the photos of the alleged victim between 12:03:57 and 12:30:12, when she's seen at the back entrance of the house and appears to be leaving. A neighbor said he believes he saw her in the front yard sometime between 12:20 and 12:30.

Based on the time-stamps, there is a 16- to 26-minute window in which she could have been assaulted. But, during most of that time, Seligmann may not have been in the house.

Sources for the defense tell CBS News that cell phone records show Seligmann made calls at 12:07, 12:09 and 12:11. At 12:14, he called a cab to pick him up. Driver Moez Mostafar says he got that call and showed CBS News his dispatch records to prove it. He says he picked up Seligmann at 12:19.

"He looked normal, nothing looked unusual to me," Mostafar said. "He asked me to go to Wachovia Bank where he can get some money.

They note she also e-mailed a New York public relations firm, asking in her letter for advice on "how to spin this to my advantage."

Seriously though. Nifong has got to be banging his head against the wall considering the dumb*sses on who his future depends. I hope he gets a big fat headache. Can't wait until that's introduced in court.

And if FB is saying that he's guilty of misconduct, how would she possibly think she could continue the case. Anyway, if she's elected, when would she be sworn in? The way it's going it could all be over by them.

I can't even see these cases making it to court. What did he put his calls on hold when he was raping her? The timeline makes no sense. Perhaps the DA should have the victim pick out two new defendants and try again.

It is very distressing that Finnerty's deal in his D.C. problem may now come unglued because it provided that he not only not be ~convicted~ for another crime but that he not be ~arrested~. If he has a strong alibi in the LAX matter, it would be absolutely outrageous for him to be punished in D.C. because of Durham ~allegations~.

There's been a lot of detail about Seligmann, not much about Finnerty. Have witnesses come forward who were with him at the Mexican restaurant? Do any restaurant employees remember him?

IMO, the chances of this ever getting into a court room are about nil. It probably won't even get into a civil court room. That is, unless the accused file suits for wrongful arrest or the like (doubtful, too, but who knows).

I don't think I've ever seen a case unravel as quickly and as convincingly as the case against Seligmann. This was REALLY botched.

Finnerty's attorney has kept this info close to the vest. Prosecuting witnesses are changing stories to fit new facts. Kim's memory of Finnerety at the party is a classic, I don't think she knew he also had an alibi.
My guess is that Nifong will indict yet another player when the grand jury meets again (May 1) so he can have a perp walk on election day. Doesn't matter who (as evidenced by indicting the two guys with alibis).
