Obama’s ineligibility: Marco Rubio can’t be President or Vice President
Canada Free Press ^ | September 20, 2011 | Lawrence Sellin

The critical issue for the 2012 election is whether or not a government of the people, by the people and for the people, shall perish from the earth.

The US Government has been hijacked by a self-serving, permanent political class, which considers itself above the law and elections as bothersome formalities temporarily interrupting their plundering of the nation’s wealth.

Having become comfortable with ignoring the will of the people, American politicians have created a culture of corruption in Washington, D.C., while they steadily whittle away at the Constitution to remove any remaining obstacles in their pursuit of personal power and affluence.

The rule of law has deteriorated to such an extent that it is now possible for Barack Hussein Obama to present a forged Certificate of Live Birth on national television, to use a stolen Social Security Number and forge his Selective Service registration without a single member of Congress raising an objection.

In 2012, these same politicians will ask voters to ignore Obama’s crimes like they have and endorse their endemic corruption.

Being born in the USA is not the standard.

Being born a citizen is.

The Constitution mentions two types of US citizens. Those that must be naturalized and those that are natural born.

There are two ways, and only two ways, of becoming a US citizen.

One is either born a citizen or one must be naturalized.

Do an “in forum” search on the the guy who posted this thread. It’s by far, his favorite saying. Bordering on OCD.

So everything enacted during Andrew Jackson’s presidency is null and void?

Did you read the article...intent of Founders were NBC not native born as Rubio is. IF the GOP goes down this route...they are NO better than what the dems have done with barry...I've been waiting for another good source stating the obvious...you can't get much better than this organization.

I thought you were boxed up all day with teaching? OR is it you have a late class on Tuesdays?

This is already true since the GOP never formally objected to Barry on the basis of his lack of constitutional eligibility. You don't even need to understand the legal precedents to understand that the founders of this country would not have wanted the child of a foreign national to be president of the united States, regardless of where he was born. Plenty of GOP members have either ignored the Constitution and/or made excuses for Barry that just don't wash. Why would they do any different for Rubio or Jindal, especially if they think these guys have a shot at winning the White House??

This in no way did barry set a precendent...now if the GOP try this with Rubio...that's a whole nother can of worms.

I look at laws this way...if a person murders someone and gets away with it...is that a new set precendent? We can now all go around murdering people.

That “Clearly Defined on these threads” definition is just plain wrong. I suggest you consult with some legal scholars about what the “intent” of the founders was. All the controversy over Obama wasn’t about his parents citizenship,it was about whether or not he was born in the U.S. (Hawaii). That’s is why the “Birth Certificate Issue’ is at the heart of the argument. Anybody who tries to push the “parents citizenship argument” will get tossed out of court before they can file the papers.

Andrew Jackson, born in South Carolina (some say North Carolina) of parents of Irish birth, was a citizen of the United States at the time of the adoption of the Constitution and thus meets the citizenship test of Article II, Section 1.

A good analogy for Marco Rubio's eligibility would be that of Chester Arthur, who is reported to have been born in Vermont and was the son of an Irish-born father and a native born American mother. He would thus be considered to be natural born citizen, as would Rubio, who was indisputably born in Florida of Cuban-born parents.

If Rubio is nominated for POTUS or VPOTUS, the Left will turn on a dime. Suddenly, eligibility will matter—and the working definition of NBC will be “born of two citizen parents.”

The Supreme Court binding precedent in Minor vs. Happersett (1874) provides the Constitutional definition of natural born citizenship.

The Court in Minor did make a direct holding that Mrs. Minor was, in fact, a US citizen. The Court established her citizenship by defining the “class” of “natural-born citizens” as those born in the US to parents who were citizens.

This is clearly incorrect. Read "Minor v. Happersett." The Court specifically did NOT define "natural born citizen."

There are two ways, and only two ways, of becoming a US citizen.

One is either born a citizen or one must be naturalized.

So which is Rubio? He's never been through a naturalization ceremony, so he must have been born a citizen.

The link references Minor v. Happersett as a "binding precedent" defining a natural born citizen as the child of citizen parents.

It does nothing of the sort.

From the written opinion:

"The Constitution does not, in words, say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens, as distinguished from aliens or foreigners. Some authorities go further and include as citizens children born within the jurisdiction without reference to the citizenship of their parents. As to this class there have been doubts, but never as to the first. For the purposes of this case it is not necessary to solve these doubts."

The question of whether parental citizenship is required to qualify as a "natural born citizen" remains one that has never be definitively settled by statute or by case law.

I’m almost starting to wish Rubio would run if only to kake the Dems question his elgibility. Then Rubio could say, Ok I’ll prove mine, you prove yours Barry.
