A few days ago, the Blaze reported on the low-key plans of the Obama administration to increase the penalties for certain gun law violations, and add steps to the background checks for legal gun ownership.
Today the administrations plans are beginning to come into effect. Through an Executive Order, the Obama administration is implementing new restrictions on the sale of certain weapons in border states, and increasing the penalties for violating certain firearms laws.

I am not being funny here...I really don’t understand how we can have all these EXECUTIVE ORDERS. Why have a Congress? If a President, any President, and just DECREE a new rule, a new law, a new regulation, aren’t we already living in a dictorship? Seriously, can Congress overrule an Executive Order? IF so, how? I really don’t remember anything in Constitution regarding executive orders.

What happened to equal protection? Obama can't order a federal regulation that only affects four states, can he?

Except that it isn't "law of the land" if it only affects four border states.
Equal Protection should require that this edict apply to all states in the union or else it is unconstitutional.

Well, in theory, it works like this (I think, at any rate.) :
An executive order is a directive from the President to the bureaucracy. Supposedly, they don’t have the same weight as law. The problem is: the bureaucracy is now making regulations that carry the weight of law. (See the EPA, FDA, Department of Education, Department of Energy, etc.)
Congress can nullify any executive order with legislation and they can be challenged in court IF it appears that the President is attempting to craft legislation with an executive order. (And the judge has read the Constitution and is not a leftist pig.)
I’m not a lawyer (despite spending last night at Holiday Inn Express and I don’t play one on TV) but that’s the best idea I’ve got.
