Well, at least Judge Whittemore is asking for the Schindlers' attorney (and the DOJ) to provide arguments to back up the constitutionality of the statute instead of just declaring it unconstitutional from the start. Please keep Gibbs in your prayers...I'm sure he's typing on a computer right now and suffering from extreme sleep deprivation.

Yes, it is interesting - but if they would write it in plain English it would be helpful.
However, when the left wants to confuse the public they use legalese primarily because THEY KNOW WE WON'T UNDERSTAND!!

Gibbs's arguments for a de novo (brand new) review in accord with congressional legislation hinge upon Judge Whittemore first rejecting the Felos brief questioning the constitutionality of this morning's congressional action.
Either way, we want a quick ruling so it can be taken from this clown and appealed to the 11th CCOA.

His job is not to question the "constitutionality" of the case. Congress clearly has the power to decide federal court jurisdiction. The constitution is unambiguous on that point. He's another one of those who thinks judges are gods, not to be interfered with by the legislature or any silly group of the people's representatives.
