Newark mayor says ICE agents raided 'without warrant,' violated Constitution

New Jersey Democrats and immigration activists vowed to fight against President Donald Trump's immigration policies after eight people were detained Thursday in an ICE raid in Newark.

Newark Mayor Ras Baraka, members of Congress, state officials and migrant activists on Friday spoke at a news conference, where the mayor claimed U.S. Immigration and Customs Enforcement (ICE) acted without a warrant and detained workers, including a U.S. military veteran.

"The problem with this is that none of these people were rapists, or murderers or criminals," Baraka said. "The problem with it is that ICE went in there without a warrant."

The mayor also said that Newark must remain a sanctuary city for migrants.

"We don't want an ICE detention in Newark. What we are concerned about is the erosion of the Constitution," said Baraka.

Officials and immigration activists said that ICE agents detained four women, who were all mothers, and four men. The mayor said he was "appalled" to learn that those who were detained had been fingerprinted and had pictures of their IDs taken, and he accused ICE of violating the Fourth and 14th Amendment rights of those detained.

Asked if he is afraid of prosecution for refusing to cooperate, Baraka said he is not.

"If [Trump] thinks that we're just going to go to jail quietly, he's got another thing coming," the mayor said.

They’re lying. A city councilwoman in Detroit lied about raids there, just to be refuted by the mayor himself. This is probably the same thing.

Yup. A lot of businesses look at fines as "the cost of doing business." Make the fines "equal" caught hiring illegals? Fine = 75% of annual REVENUE (so they can't fudge the numbers and take a loss).

Caught manipulating markets (stocks, commodities, etc)? Fine = 75% of revenue. Caught fixing prices?....you get the picture.

Also - you want to remit money back overseas? - need to show proof of US citizenship, or valid visa (ie legal presence in the US), or subject to 75% fee. If you are a business (Western Union, Venmo, Bank of Amigo, etc) and you enable illicit overseas transfers.....you guessed it - 75% of annual revenue as a fine for each year it occurred.

If that money can be traced individuals connected to drug trafficking organizations....slap on charges for material support to terrorism.

This Baraka clown is in a tough spot. Illegal aliens are the only people who would even WANT to live in his dump of a city.

“I’d like to see serious consequences for businesses that employ illegals.”

A business might be required to cough up $15,000 in return bribes for an ilicto.

The bribes might be payable in six monthly installments payable to the ilicto in their homeland within three-day windows between the 15th and 26th of each month so as to useable to pay rent.

The balance would be paid at random times at least 15 days after receipt from the business.

The amounts would be less than the short-notice return airfare between the international airport nearest the business and the biggest city in the ilicto’s homeland.

I’m sure $15,000 would buy a lot in Honduras or Mexico.

Hi, ICE, I’m working at Scofflaw Roofing at a casa at...I’d like to cash in on your $15,000 return bribe program.

Businesses could avoid getting ripped off by using E-verify.

Let me have your ID and upload it to the Treasury website. I see you’re over 18.

Oh, you’ve exceeded the $400 12-month tax-exemption amount. You’ll need to pay the progressive remittance tax. For $200 the tax will be $20, making for a grand total of $220....

[Note: 75% will result in cartel-controlled remittance schemes. Rates of 10% to $2000, 20% on the next $2000 and 25% thereafter would likely get paid.]

But did they illegally enter the United States? If so, they are not protected by our Constitution,

The issue is moot

Having been deported, the illegals can’t return to Newark to plead their cases

quotes:

An “ICE warrant” is a form issued by certain immigration officers that names an allegedly deportable non-citizen and directs various federal immigration enforcement agents to arrest that individual.

ICE warrants are issued for civil violations of immigration law, not criminal charges. They are also sometimes called “administrative warrants.”

An ICE warrant directs various federal immigration enforcement agents to arrest the person named in the warrant.

Because it is not issued by a judge, an ICE warrant does not give the immigration enforcement officer the authority to demand entry to a home or private space in order to make the arrest.

ICE warrants do not generally provide a basis for a local or state law enforcement officer or agency (LEA) to arrest or detain anyone. Federal regulations allow a specific list of federal immigration agents to execute administrative immigration arrest warrants.

An ICE warrant is directed only at authorized DHS officials, while an ICE detainer is a request directed to other law enforcement agencies.

“Under California law, employers cannot turn over employee records or voluntarily allow immigration agents to enter non-public areas of the workplace without a judicial warrant.”

Ask the officer to slip the warrant under the door or hold it up to the window, so you can inspect it.

They might show administrative forms (I-200 and I-205). But if they don’t have a warrant signed by a judge, you may refuse entry.

Check for signature by judge.

If it’s a search warrant, make sure it is for your address; if not, you don’t have to open.

If it’s an arrest warrant, make sure it is for someone who lives at your address; if not, you don’t have to open.
