Which isn't a distinction in LOAC. LOAC is treaty law: This means that treaties and agreements the United States enters into enjoy equal status as laws passed by Congress and signed by the President.

They may be killed or wounded and, if captured, may be tried as war criminals for their LOAC violations.
Terrorists captured and held under this authority. Unfortunately no executed. But this is why they need not be captured and can be shot immediately on the battlefield.

Well, first off US Law does cover foreigners and things that happen on foreign soil in a lot of cases. If you go back to the Supreme Court decision after the civil war it said that it was unconstitutional to use Military Tribunals against civilians in an area where normal courts were operating. So that leaves two clear cases where military tribunals could still be used:
Against foreign military people.
Against civilians in places where normal courts are not operating
These are exactly the conditions that were in place in the War on Terror in Iraq and Afghanistan. The US Military arrested people who they termed "enemy combatants" (thus depriving them of Prisoner of War status, as if they had belonged to a legitimate national Army) and has held them, some for a very long time indeed.
That got challenged (not just the holding, but the trials of them) all the way up to the Supreme Court, lost one round, rules got slightly re-written, and then approved.
So we can keep doing what we are doing at Gitmo, in the same circumstances, no problem.
Now let's go to the idea that at some point in the near future that President Trump is going to unleash the Marines to go arrest 30,000 people which there are sealed warrants for in the USA, take them to Gitmo, and try them in military tribunals.
If we are talking about the people we all know and hate, like Susan Rice, Valerie Jarrett, Bruce Ohr, attorneys at Perkins Coie, up to an including Hillary and Huma -- this would clearly violate the case law around using military tribunals because A) they are not members of a foreign military and B) the civil courts in America are functioning.
I do not believe President Trump would ever order something that would clearly be unconstitutional, and almost certainly result in a humiliating defeat in the Supreme Court upon review (which would happen instantly, like Bush V. Gore).

I think that the Jeff Sessions plan of arresting them one or two at a time and trying them in Federal Courts, as you say, outside if the District (or NYC, or 9th District) would be the way to go.
So the Huber move, if it's ever acted on, would be brilliant. As you say, not in D.C.

According to case law, no. Lincoln tried this and the US Supreme Court said no. OK, that was during and after the civil war. We are not in a civil war (perhaps a cold civil war, but we don't have States in secession, armies on the field, cities undergoing siege, etc.
Therefore there is zero reason for using military tribunals in the USA, or against US Citizens arrested abroad, who can be brought back here to face civilian trials.
To do so would pose a huge risk of illegitimacy to any proceedings undertaken that way.
People are really blowing it on the “Q” tripcodes and message IDs pointing to books via search engines, etc. - that’s the way search engines work!
We saw this before, that people would quickly latch onto a new obscure term or code in “Q” posts. In one example, a weird set of MKUltra videos would be quickly manipulated by their publisher on YouTube - as soon as a post was made by “Q”, the publisher would insert the embedded codes from the post into the video description and - voila - then a Google search would quickly turnaround and it APPEARED as if come cryptic code in a “Q” post was tied to these weird and wacky videos!
In this case, however, keep in mind that people have been posting “Q” all over the place - on blogs, here, there, everywhere (even behind you lol) - the search engines have no concept of what a “Q” tripcode is - but they quickly start learning: a tripcode is just like any other search term and the (actual / real) bots start feeding back submissions that tie the content of a “Q” post to a blog, for example, that has advertising (long collecting data) or analytics (like here on FR) along with other things that link to other things, etc., etc.
When it’s all done & cooked you have established associations between all these things and people. The search engines start making logical associations between trip codes + post id’s etc. and things those sites, their publishers, readers, consumers, etc., are interested in and purchase. voila!
Probably the most bewildered are those that have posted when following these rabbit holes they end up at things only *they* are tied to - I saw one post somewhere at one point where the poster was shocked to see, besides being tied to all kinds of things relative to “q” posts, an Amazon contextual object somewhere also presented an obscure book only the poster would be interested in & thus in the poster’s mind further expanded the reach of these things, oblivious to the real reason - which is, simply, this is how search engines + advertising engines work!
They did that because they were 'unlawful combatants'. LOAC. There is only 'lawful' 'unlawful' and 'non-combatants'. In order to qualify for POW status one must be a lawful combatant.
