(AP) — A suspect arrested in connection with last weekend’s mass shooting outside bars in Sacramento served less than half his 10-year sentence because of voter-approved changes to state law that lessened the punishment for his felony convictions and provided a chance for earlier release. Smiley Allen Martin was freed in February after serving time for punching a girlfriend, dragging her from her home by her hair and whipping her with a belt, according to court and prison records. A unanimous decision by the California Supreme Court ruled that certain sex offenders are eligible for early parole. It stems from a 2016 ballot measure sponsored by then Governor Jerry Brown. Prop 57 allows offenders who are classified as non-violent to be released from prison early. San Diego District Attorney Summer Stephan says around 4,500 sex offenders in California will now be eligible for parole.

One of the men arrested for shooting dead six people in a wild gunfight in Sacramento on Sunday filmed himself on Facebook live brandishing a weapon hours before allegedly opening fire. Smiley Martin, 27, appears in the video holding a black handgun which he pointed towards the camera. One of the guns used in the shooting was a stolen handgun, according to police. He says little throughout the 38-second clip but other men can be heard in the background. Law enforcement wiped the video from his Facebook account after his arrest on Tuesday.
