In remarks given at a judicial conference in Pennsylvania this week, Roberts reiterated his long-held view that the Court should speak with one voice wherever possible — that is to say, he supports a consensus-driven approach to opinion writing in which the justices strive for unanimity and avoid writing their own concurrences or dissents. In doing so, he appeared to rebuke Gorsuch, who has flashed a propensity for writing on his own in his first months as a justice.

The data process used to arrive at the administration’s determination that greenhouse gases endanger “the public health and welfare†violated the Environmental Protection Agency’s own peer review procedure, a new report from the EPA Office of the Inspector General reveals.Sen. James Inhofe (R-Okla.), ranking member of the Senate Committee on Environment and Public Works, requested this report in April, asking that the OIG determine whether the EPA “followed key federal and Agency regulations and policies in developing and reviewing the technical data used to make and support its greenhouse gases endangerment finding.†Now, Inhofe is calling for a series of...

If legislation were dirt, Democrats would have piled up a mountain of it over the past 18 months, digging themselves in a deep political hole in the process. The House that Nancy (Pelosi) built continues to ramrod new policies through the legislative process, hoping the bustle will salve America’s sour mood. Senate Democrats move a little more slowly due to different institutional rules, yet their hearts are in the same place: the more legislative production the better. That’s what legislators do, after all. New laws are like seed corn, intended to grow public support. But it’s not working. The congressional...

After enduring the coldest winter for 30 years, you might have been hoping for some respite from the cold weather. However, scientists are now warning that Britain can expect to endure a series of extreme winters - the like of which have not seen for more than 300 years. Researchers have found that low solar activity - marked by a decrease in the sun's magnetic field - influences the weather conditions across northern Europe. The last time the sun showed similar behaviour, between 1650 and 1700, temperatures dropped so low that Londoners were able to skate and hold fairs on...

The headline on this Guardian article is pretty sanitized: http://www.guardian.co.uk/environment/2009/nov/23/climate-change-emails-uea "Climate change email hacking to be looked into by University of East Anglia" But you don't have to read very far to see that the media has zero interest in investigating the content of the emails. They want the leakers destroyed; as do the scientists.

Is there something cyclical, but nevertheless extraordinary, happening in American politics these days? Are we moving from a period of partisan confrontation and division, to one that values consensus and seeks more unity among our public figures? Otherwise, how can we account for the unusual persistence with which moderates like Rudy Guiliani and Senator John McCain are holding their large leads in the Republican primary electorate? Or, the surprising surge of perceived-moderate Senator Barack Obama into second place in the Democratic field? The conservative right is trailing ignominiously in the polls for the Republican nomination, while Hillary is tied with...

You see it in daycare centers, and you see it in the public schools, from kindergarten to high school. Group projects abound, shoving together individuals who have no formal bonds, yet are banded together for the purpose of collective decision-making. Universities, both public and private, are not immune to this affliction. In fact, if you attend a business college today, you’ll think it’s the newest rage, but it’s been the rule for decades. Most university programs may not use group projects, but undergraduate and graduate programs in business are full of them. It is our contention that group projects are...
