I've also moved this race to toss-up status. But I'm not as scared of Lautenberg as a lot of pundits think I should be. This guy was never invincible in his prime, and now he's 78, and been out of the game a couple years. Forrester can still win, even if this ruling holds up:

I am with you. If one puts all these thing together -- Daschle's supermajority, Florida elections, McDermett/Bonier, This NJ ruling to toss out the rule of law -- it is scary. I have a cousin who is an ardent environmental-looney. The last time I saw him, I brought up the Constitution and Elections to solve controversies. He replied that, "Some things are just too important for democracy". The Democates are at this point now. If they can, they will disenfranchise conservatives and even the small handfull fo rational liberals in their own party.

About 10 or 12 years ago we had a Republican Gubernatorial candidate accused of sexual misconduct. He dropped out of the race and the man who came in second in the primary, Arne Carlson, was allowed to run in the general election. All of this took place in the week or so prior to the general election. Arne Carlson won.

It was more than a week, but the central point is, did the state law allow this or did the court make it up?

I think he caved to pressure from the others to be unanimous on this.

Maybe the RINOs ducked because they didn't want to tar the GOP with a "partisan decision" thinking that Forrester will probably win anyhow so why complain.

The weakness is that it won't play well nationwide.

30 years ago that would have been the case. Today it resonates with the "count all the votes" mantra. (What happens to the Forrester/Torch ballots, however, that came in before the switch? Do those get thrown away? Do Torch votes get switched to Lautenberg?)

I hope you're right. But that would represent a triumph of hope over experience. Dimmocrats seem to have learned never to underestimate the human capacity for cursing the darkness while shunning the light.

Perhaps a wise move, but a strategy still fraught with PR peril.

Forrester(or the GOP) will still have to file before the election, and irregardless of whether or not the USSC decides before election day to take the case, the Dems(and their media co-conspirators) will be screaming that the GOP and "their court" are planning to steal control of the Senate after the election. Will use that line to try and sway the close races, and especially NJ. So any PR gain for Forrester by waiting to contest will be more than countered with the Dem fearmongering of a USSC setup job, creating the perception that the GOP is no different and playing just as many political gains to win(unfair as such a perception might be.) And then if Senate control actually does end up resting on the NJ race, mama mia what a protracted howling it will be.

Tough choices ahead for the GOP strategists. The silver lining is that I think this whole fiasco likely confirms my suspicions that the swing middle was starting to shift to the GOP in many of the other key Senate races. Backs against the wall, the Dems had to return to their Clintonesque playbook of divisiveness, muddying the waters, firing up the base, and smearing the GOP in order to get the middle/swing voters disgusted with both sides and thus depress their turnout.

Since this was a governor's election, it is a state election, not a federal election, and so a lot of federal laws don't apply.
