Perhaps a wise move, but a strategy still fraught with PR peril.

Forrester(or the GOP) will still have to file before the election, and irregardless of whether or not the USSC decides before election day to take the case, the Dems(and their media co-conspirators) will be screaming that the GOP and "their court" are planning to steal control of the Senate after the election. Will use that line to try and sway the close races, and especially NJ. So any PR gain for Forrester by waiting to contest will be more than countered with the Dem fearmongering of a USSC setup job, creating the perception that the GOP is no different and playing just as many political gains to win(unfair as such a perception might be.) And then if Senate control actually does end up resting on the NJ race, mama mia what a protracted howling it will be.

Tough choices ahead for the GOP strategists. The silver lining is that I think this whole fiasco likely confirms my suspicions that the swing middle was starting to shift to the GOP in many of the other key Senate races. Backs against the wall, the Dems had to return to their Clintonesque playbook of divisiveness, muddying the waters, firing up the base, and smearing the GOP in order to get the middle/swing voters disgusted with both sides and thus depress their turnout.

Kicking up the dust inevitably depends on the compliant media to present a one sided view to the public.

Risky business. The more the media takes a one-sided view, the more that people catch on to it and cancel subscriptions or at least, begin to regard the paper's reporting and editorials as laughingstocks.

So any counterstrategy seems as if it ought to take that factor into effect. Perhaps counterstrick with a heavy bombardment of call-ins on talk radio. (Full page ads just feed the coffers of the liberal media with more cash for more liberal spin disguised as "news".)

Will Forrester have to file before the election? You have 30 days after a lower court's decision becomes final to petition the SCOTUS for cert. When does the NJSC's decision become final?

It's very simple:

Hit the Dems for the "bait and switch" from now until the end of the election. Go to SCOTUS out of concern for the military ballots - and remind the people that Lautenberg was a "selected" nominee, not the elected nominee.

That "Torricelli-Lautenberg" machine line is a good one, too. This is simply about beating the Dems around the head and shoulders with their corruption. One of two things will happen:

1. The campaign succeeds, and Forrester is elected.
2. The Dems win, and we can operate under no illusions - therefore we will have to fight as dirty as they fight in order to save our Republic.

But one thing for sure: We need to know how much of the American people will stand for this. I still think there are enough people that will be repulsed by this "bait and switch" tactic that they will use their votes to express their revulsion with that tactic.
