It's Official: LAT/WP vs Free Republic Settles

I just received official word that our settlement with the LAT/WP in their alleged copyright infringement and unfair competion suit against Free Republic (click Source link above for complete history of the case) is completely finalized with the court. I do not have a copy of the final order yet, but the basic terms are as follows:
- Unless we receive prior written permission on an article by article basis, Free Republic agrees to continue posting only excerpts (as allowed by fair use) and links from any of the LAT/WP or related publications.
- Free Republic agrees to remove all full text copies of any LAT/WP and related publications copyrighted articles from its archives and servers and to destroy all copies of same.
- Neither party is awarded any damages, attorney fees or costs except that Free Republic agrees to pay the Los Angeles Times $5,000 and the Washington Post $5,000 (these negotiated amounts have already been paid).
I will post the entire final order including the list of related publications as soon as I receive a copy and get it scanned in.
Well, my fingers are not cold and dead and my keyboard has not been ripped away. While this is not entirely a win for FR, neither is it a crushing defeat. Free Republic is alive and well and the fight against liberalism continues on. It's a crying shame that the hallowed words of the WP/LAT will no longer grace our pages, but, somehow, I am sure we will manage to live on without them.
And despite what our detractors may say, we have not committed any crimes or broken any laws and we have not admitted to any guilt. We have negotiated a mutual agreement and settlement with the LAT/WP and have agreed upon satisfactory terms for continuing forward without having to spend the rest of our lives in court.

FRee speech lives!! Glad this all worked out Jim, but it is really the LAT/WP's loss. They could have reached all of us via this medium. Their loss!!
I still think it stinks that they got any money at all, but at least it is over for you and the site continues on.

Sounds like a pretty good deal, JR. Maybe not champagne-cracking good, but I'm lifting a beer and saluting you for it, which is the least I can do. Congratulations. I suppose no one is America has truly "made it" until they've been sued. Sad but true.

Thats great! Posting excerpts from thier trashy papers is good enough for me.
I guess to those two papers, the First Amendment only applies to people who agree with you.
KNowing the original intention of the Amendment, those two "Papers," ought to be ashamed of themselves.
Oh well, I am proud that you hung in there and FR received this verdict. While not perfect, it doesn't hurt much.

Obviously you are somewhat bitter about this outcome. You fought long and hard, and eventually were forced to settle short of victory. And obviously it is the money that forced the settlement. Not what you paid, but what you may have been forced to pay if you pursued this and lost. I have nothing but contempt for those newspapers and the multi-millions of dollars they have to throw at those who might challenge them, even though under our constitution we have the right to speak and write criticisms of what they publish. But you had to think about your own health, and the well being of your family and supporters in making this decision to settle. It isn't what you or any of us wanted, it doesn't do anything to advance free speech and it leaves a lot of issues unsettled. But at least FR has survived, and hopefully, will come out it a way that will allow conservative viewpoints to continue to be expressed. Not many of us would have had the courage to challenge these corporate giants, and put all you have on the line to do so. I feel strongly that the First Amendment lost, but that you are heads and shoulders above 99% of us in pursuing this fight. My best to you and may FR continue to be as strong as it is today.
