Supreme Court says states can count mail ballots that arrive after Election Day

Washington — The Supreme Court on Monday ruled that states can count mail ballots that are cast by Election Day but arrive later, rejecting a GOP challenge to Mississippi law's for late-arriving ballots.

In the closely watched election dispute known as Watson v. Republican National Committee, the high court split 5 to 4 in finding that Mississippi's measure does not conflict with federal statutes that set Election Day as the Tuesday after the first Monday in November in certain years.

Justice Amy Coney Barrett authored the majority opinion, joined by Chief Justice John Roberts and the three liberal justices to uphold Mississippi's law. 

"The Framers recognized the difficulty of crafting election laws 'applicable to every probable change in the situation of the country.' So instead of constitutionalizing election law, they decided that 'a discretionary power over elections' needed to be lodged 'somewhere,'" Barrett wrote. "Suffice it to say, that power was not lodged in this Court. The election-day statutes say nothing about ballot receipt, and we cannot add to the words Congress chose." 

Federal election laws requires the electorate to make its choice on Election Day, she said, which happens as long as that is the deadline for voting, like it is in Mississippi.

"But the election-day statutes do not set a deadline for ballot receipt, so they do not prevent Mississippi from counting ballots postmarked before election day yet received afterward," she said.

With the November midterm elections just months away, the case threatened to upend similar laws in more than a dozen states that allow ballots that are postmarked by, but arrive after, Election Day to be tallied.

And I don’t have a real problem with that. Once I mail something, it is subject to the tender ministrations of the USPS...nothing I can do. And I can think of hundreds of military ballots that could be potentially tossed because they were “late”.
I DO object to thousands of supposed mail in ballots that flood in days after the election. The postmark is the key...i’m not aware of those can be faked...

I have not read the SCOTUS ruling, but the news reports have said nothing about the fact the US Post Office does not postmark envelopes that have prepaid postage.

So how are the SCOTUS Justices going to know that a mail ballot was indeed cast before election day has ended????

What SCOTUS actually decided was NOT specifically that counting ballots X days after an election was O.K. or not. They only decided that the President does not have powers either by the Constitution or the laws to independently decide that question. Why? No federal law enacted by Congress prevents it. It remains a decision by each state.

If Congress does enact a federal law against late ballot counting in Federal elections THEN you will get a challenge to that law and at some point a SCOTUS review of it. THEN, and not before, will SCOTUS be specifically deciding the issue of “late ballot counting”.

This is the second article that I’ve seen on FR today that’s mischaracterized the ruling.

This ruling is explicitly in relation to Mississippi’s laws regarding absentee ballots; not mail-in ballots in general.

No, absentee ballots.

Mail-in ballots aren’t the same.

An absentee ballot must specifically requested.

Mail-in ballots are not requested.

.... Well ..... If the stipulation is that ALL Mail in Ballots must be Postmarked by midnight before the Election Day at the latest .... Then like all other mail .... Wouldn't those Ballots take a few days after Election Day to arrive at their destination?
