Two activist judges with a track record of sabotaging President Trump’s America First agenda have just ghosted a critical Senate hearing aimed at exposing judicial overreach.
U.S. District Judge James Boasberg and U.S. District Judge Deborah Boardman have both turned down invitations to testify before the Senate Judiciary Committee this week at the explosive hearing titled “Impeachment: Holding Rogue Judges Accountable.
Their absence should come as no surprise to anyone paying attention. These are not neutral judges, they are political operatives wielding federal robes as weapons against the will of the American people.
Judge Boasberg, a Barack Obama appointee, has drawn fierce ire from conservatives for his ruling that blocked the administration’s attempt to deport Venezuelan nationals under the wartime Alien Enemies Act (AEA).
His decision came even as the White House sought to remove terrorist members linked to the Venezuelan group Tren de Aragua.
Boasberg’s ruling described the mass deportation attempt as lacking due process, since there was no precedent for using the AEA against illegal immigrants in peacetime.
Republicans who view expedited deportation as vital to national security and border integrity see Boasberg’s ruling as judicial overreach.
Boasberg’s fingerprints are also all over the shadowy Arctic Frost FBI operation.
The Biden-era witch hunt that spied on the private communications and cell phones of at least eight Republican senators and nearly a dozen GOP lawmakers probing 2020 election irregularities.
We’re talking secret subpoenas for toll records, intercepted calls, and a full-on surveillance dragnet approved under the radar by none other than Boasberg himself.
In a statement shared on X, investigative commentator Mike Benz laid out three specific criminal charges that Attorney General Pam Bondi could immediately bring against Judge Boasberg in connection to the Arctic Frost scandal.
1. Deprivation of Rights Under Color of Law (18 U.S.C. § 242): The prosecution alleges that by issuing the gag order, Judge Boasberg willfully deprived U.S. senators of their statutory right under 2 U.S.C. § 6628 to receive notification of legal processes seeking disclosure of Senate data, thereby violating their constitutional protections under the Speech or Debate Clause and separation of powers principles.
Meanwhile, Judge Boardman, the Maryland radical judge, has turned her courtroom into a sanctuary for open-borders chaos. Boardman has blocked Trump’s executive order on birthright citizenship.
In August 2025, Boardman issued a nationwide injunction blocking the administration’s order to roll back “birthright citizenship,” effectively rejecting an effort by the current White House to restore a meaningful safeguard on automatic citizenship for children of illegal immigrants.
President Trump, in September, asked the US Supreme Court to end birthright citizenship.
“The Trump administration asked the Supreme Court on Friday to review the constitutionality of President Donald Trump’s executive order seeking to end birthright citizenship, pushing the issue back before the justices for the second time this year,” CNN reported.
“The lower court’s decisions invalidated a policy of prime importance to the president and his administration in a manner that undermines our border security,” DOJ Solicitor General John Sauer told the Supreme Court in the appeal obtained by CNN. “Those decisions confer, without lawful justification, the privilege of American citizenship on hundreds of thousands of unqualified people.”
Weighing in on the standoff, former DOJ veteran Tom Dupree called the judges’ refusal entirely predictable, Tampa Free Press reported.
“I can promise you that the last thing in the world they would want to do… is answering questions under oath from United States Senators,” Dupree said on Fox News Live.

My guess is not one damned thing.
It’s a separation of powers matter. Congress has no oversight authority over the courts, and it is in the interest of American businesses to have a functioning federal court system.
Let me guess. Another federal judge will declare federal judges are protected by “separation of powers”
Contempt of Congress, followed by a request to DOJ to prosecute.

Why is this a big deal? They were invited, it says (not a subpoena?) and they refused.
So what. If there was no legal obligation, why would them saying no be significant?

They should hold slimey Boasberg in contempt and issue an order of suspension of duties until he complies. Make him show up in court. In the meantime. The senate should subpoena his business and personal emails for conversation related to Trump and the other victims for time frame leading up to these bogus witch hunts.

True in a larger sense, however, it can impeach and remove a judge. The actions in this instance just might warrant impeachment.
Next time subpoena them - make it INvoluntary for them to show up and explain themselves. And if they plead the 5th, the implications are clear that they know that they did something wrong.
Congress approves the judiciary budget each year. Apart from cutting the judges’ salaries, Congress can increase or decrease the judiciary's budget. And Congress has the authority to set the jurisdiction of the District Courts, and historically it has done so. In fact, reforms to the Judiciary Act to restrict the issuance of nationwide injunctions against the President are desperately needed.
Issue an apology for asking!
This was another stupid PR stunt by the Stupid Party.
This "hearing" has no legitimate legislative purpose. And the GOP majority did not have the balls to compel appearance with a subpoena, BECAUSE the hearing had no legitimate legislative purpose, and such a subpoena would have been quashed in. a nanosecond.
The Senate has the power to TRY Judges Boasberg and Boardman, and if convicted remove them from the bench - EXCEPT THEY HAVEN'T BEEN IMPEACHED BY THE HOUSE.
A "hearing" to "expose" anything is illegitimate, and I wouldn't blame any court including the USSC to issue an order forbidding it.
Congress may need a time out to recover some sense of its role and its purpose.
There actually IS a Constitutional way for the Republicans to allow the President to dismiss Congress - but the GOP would never go for it.
