Gavin Newsom Sues Trump over Tariffs

California Gov. Gavin Newsom (D) announced Wednesday that the state is suing President Donald Trump over his recent tariffs, claiming that they are hurting the state and that he lacks the authority to enact them.

Bay Area public radio station KQED reported:

Gov. Gavin Newsom and Attorney General Rob Bonta are asking a federal court to pause the tariffs being levied against Mexico, China and Canada, as well as the across-the-board 10 percent tariff enacted by Trump. The suit argues that the law the president is relying on — the International Economic Emergency Powers Act — has never been used before to justify tariffs, and that Trump needs Congressional authorization for actions with such broad economic consequences.

“President Trump’s unlawful tariffs are wreaking chaos on California families, businesses, and our economy — driving up prices and threatening jobs. We’re standing up for American families who can’t afford to let the chaos continue,” Newsom said in a written statement.

The lawsuit cites the U.S. Supreme Court’s “major questions doctrine,” a legal principle that assumes Congress must weigh in on issues of major political or economic significance. The Supreme Court relied on the doctrine to strike down laws related to pollution control and student loan forgiveness under Presidents Joe Biden and Barack Obama, the governor’s office noted.

This involves international trade and relations something even the Court has deferred to the executive branch. This is not a congressional law on student loans. They may find a stupid District judge to agree, but Trump will never comply and the Ninth Circus may not even want to touch this.

Just looked briefly at Wikipedia page for act, and it seems obvious already Newson’s suit is nonsense. It clearly authorizes tarrifs and more as economic remedies to actions taken by other countries that the President thinks is harming us economically.

This may be an issue where both the executive branch and Congress have authority. The executive branch administers laws passed by Congress. Only the executive branch has the power to conduct foreign policy. Arguably responding to unfair tariffs on US goods, by imposing reciprocal tarriffs is conducting foreign policy.

However only Congress has the power to levy taxes under the Constitution. A tariff is a tax. While the president administers taxes passed by Congress he cannot arbitrarily establish or impose a tax which has not been passed into law by Congress. California has asked the courts to determine if the very old federal law Trump is claiming gives him the authority to levy a new tax (ie tariffs) selectively.

Suppose Obama or Biden (or maybe the next Democrat President....) had declared a "climate emergency", and had tried to use the very broad claims of presidential powers for that "emergency" to force us into a green economy.

How would we have reacted to that assumption of powers by those Presidents?

We have to see more than just what is right in front of our noses in a given moment. Otherwise, we're going to hand the left the ropes they will use to hang us.

As Newsome is well aware, Tariffs are enshrined in the constitution as part of federal trade with other nations which is PURELY a federal level function and not a states one.

The states do have power here… by ordering their reps in the Senate to revoke it… oh wait, they gave up that power with the 17th amendment.

Well they still have the power of the ballot box… so they can change it in 4 years.

Unless, yknow, Newsome is arguing for states rights…

But of course, he’s really just serving his CCP master by using the state treasury to ingratiate himself.

Y’all remember when Texas wanted to build the border wall and was told that immigration was a federal thing and that a state couldn’t interfere?

I do, and this should come back to haunt CA now.
