Jury deliberations begin in veteran Daniel Penny’s trial over using chokehold on Jordan Neely

NEW YORK (AP) — Jurors began deliberating Tuesday in the trial of a military veteran charged with using a fatal chokehold to subdue a man whose behavior was alarming passengers on a New York subway train.

The anonymous jury is weighing manslaughter and criminally negligent homicide charges in the death of Jordan Neely, a troubled street performer who was homeless. The veteran, Daniel Penny, has pleaded not guilty.

Penny, 26, has said he was protecting fellow subway riders and intended only to restrain Neely and hold him for police, not to hurt him. Prosecutors say the Marine veteran used far too much force for too long when he gripped Neely by the neck for about six minutes.

The deliberations follow a month of testimony in the closely watched case. It has animated debate about public safety, societal responses to mental illness and homelessness, the line between self-defense and aggression, and the role of race in all of it.

I know AP, but my prediction is a hung jury, but it is NYC, so who knows.

Been on the NYC subway a few times in the 80's and early 90's, luckily no problems, but everyday subway riders probably see a lot of alarming behavior.

I was on the Paris Metro in the mid 90's and between a stop 3 gypsy or is it romani, women boarded and asked for money. It was in French, but they were polite, and left the train before the doors closed.

Everyone should be saying "Thank You".

I hope the hell they acquit. I saw him on the video of the interrogation. This is one good guy.

Absolutely agree.
He did what nobody else had the courage to do. That is the definition of a hero.

I agree. Hung jury with most of the jurors on the NG side which will give the DA pause to retry the case.

That Penny was ever charged and brought to trial is a stain on this country’s justice system. Alvin Bragg and his office have let go so many undeserving criminals and he selects this white guy who was trying to save people. An absolute stain.

If Penny's trial results in conviction, or even a hung jury with a re-trial, the chill on any Citizen helping innocents threatened by evil-doers would be huge.

The fact that the case was even brought sends a warning message.

The media is overly excited about this because it’s racism as they own and define it, and they might get a white male Cristian Marine locked up for 25 years over it.

I’m predicting either a hung jury, or the jury will decide that Penny must be convicted of *something*. So they’ll convict him on the lesser charge (criminally negligent homicide).

And as a side note, AP continues its disgusting “reporting”. They just had to mention that the crazy guy “sometimes entertained passersby with Michael Jackson impersonations”.

So, see? The crazy guy wasn’t really a menace. He was instead a showman.

White guy + black “victim” + Manhattan = guilty on all charges. And as for appeals...there’s not a state judge in the state who’ll overturn any of the convictions. His only hope will be the Federal courts.

If my long departed Dad had seen this photo he’d ask “how much does she charge to haunt a house?”

criminally negligent homicide - 1—4 years. If convicted he might get 1 year given his good background.

We’ll see, hope he gets a hung jury.

SPJNK, and he was one of them. Liberals in control of the justice system caused his death. He had been arrested more than 40 times. Had he been in prison where he belonged, he’d likely still be alive. Unless he was killed by a fellow inmate in the mental ward that is.

Any where other than New York, the jury would have rendered their not guilty verdict already.

How is that decision to secede from the nation going New York? Can I offer any assistance? Also, those resident's of New York who want to remain in the U.S. we need to start working on the division of New York state as was done for West Virginia roughly 160 years ago.
