Hochul heralds Supreme Court gun decision as ‘glimmer of hope’

New York Gov. Kathy Hochul (D) celebrated the Supreme Court’s decision to uphold a federal law banning domestic violence abusers from having a gun, noting that it shows a “glimmer of hope” from the justices.

Hochul joined MSNBC’s Alex Witt Friday to discuss the decision from the high court and her efforts to disarm abusers in New York state.

Witt asked Hochul if she was surprised that the justices upheld the law, given the same conservative justices overturned other gun-related measures.

The decision is not nearly as bad as they are making it out to be.

It is probably the best we could do given the current makeup of the court.

The decision did not address due process issues, and is an "as applied" which means to this case only decision, rather than a general decision upholding the law.

It just means, in some cases, such as this one, the law may be constitutional.

In the Rahimi case, Rahimi stipulated to the facts and agreed to the decision.

The opinion is not precedential for cases where the facts are disputed and the order not agreed to.

She didn’t celebrate the bumpstock decision.

From the New York Post: “ Gov. Kathy Hochul issued a statement Friday in which she erroneously linked the illegal use of bump stocks to the 2022 mass shooting at a Buffalo supermarket where a white supremecist killed 10 black people.”

“ Asked later about the misstatement by the Associated Press, Hochul spokesperson Maggie Halley said the governor had only been speaking “generally” about “dangerous, illegal modifications” of weapons made to inflict mass casualties “including bump stocks.”

There was only one ideological 6-3 split out of all of yesterday's decisions with Munoz.

Otherwise, some interesting pairings here.

This USSC decision was mistaken, and sets back the 2A one more baby step.

Shall not be infringed is pretty clear, and no, there isn’t any room for restrictions.

If a person is fit for society, there should not be restrictions upon their ownership of firearms.
